WHEREAS, the City of Newark desires to award a contract to a vendor to enable the City to accept payments for real property taxes, water and sewer charges and other local unit obligations via internet, telephone and in person by credit cards, debit cards and an electronic fund transfer system; and
WHEREAS, the Government Electronic Payment Acceptance Act (P.L. 1955, c.325) authorized the Division of Local Government Services to establish regulations for municipalities to accept electronic payments; and
WHEREAS, the Department of Community Affairs, Division of Local Government Services has promulgated regulations, N.J.A.C. 5:30-9.1 et seq. authorizing municipalities upon passage of a resolution by the Governing Body to accept credit card, debit card and electronic payments in accordance with the provisions of the Administrative Code; and
WHEREAS, the Acting Director of Finance/Chief Financial Officer has recommended to the Municipal Council the adoption of a Resolution establishing electronic receipts via the internet, telephone and in person for the payment of real property taxes, water and sewer charges and other local unit obligations; and
WHEREAS, the City of Newark is in need of being able to accept payments for the above via internet and telephone; and
WHEREAS, payment of property taxes, utilities and other fees by way of credit card, debit card and electronic payment via internet and telephone will create a greater convenience for the City of Newark taxpayers; and
WHEREAS, pursuant to N.J.A.C. 5:30-9.4 contracts for acquisition of electronic receipt equipment and services shall be subject to the provisions of N.J.S.A. 40A:11-1 et seq.; and
WHEREAS, N.J.S.A. 40A:11-4.1(j) specifically authorizes the City to use competitive contracting to award a concession contract; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3(a), in order to initiate competitive contracting, the Municipal Council must pass a resolution authorizing the use of competitive contracting each time specialized goods or services are desired to be contracted; and
WHEREAS, the competitive contracting process shall be administered by the Acting Director of the Department of Finance, pursuant to N.J.S.A. 40A:11-4.3(b) and any contract awarded under this process shall be made by resolution of the Municipal Council, subject to the provisions of subsection e. of N.J.S.A. 40A:11-4.5.
NOW THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council hereby authorizes the use of competitive contracting, pursuant to N.J.S.A 40A:11-4.1 et seq. to procure a concession contract to enable the City to accept payments via internet, telephone and in person pursuant to the Government Electronic Payment Acceptance Act (P.L. 1955, c.325);
2. The award of such a contract or contracts shall be by resolution of the Municipal Council.
3. The competitive contracting process shall be administered by the Acting Director of the Department of Finance, pursuant to N.J.S.A. 40A:11-4.3(b) and any contract awarded under this process shall be made by resolution of the Municipal Council, subject to the provisions of Subsection e. of N.J.S.A. 40A:11-4.5.
STATEMENT
This resolution authorizes the use of competitive contracting pursuant to N.J.S.A. 40A:11-4.3 et seq. to procure and award a concession contract to enable the City to accept payments for real property taxes, water and sewer charges and other local unit obligations via internet, telephone and in person through credit cards, debit cards and an electronic fund transfer system.
