This Amending Resolution authorizes the City’s Department of Public Safety, Police Division to utilize the contract for armed security guards and to increase the contract amount by $582,400.00 for new a total contract amount not to exceed $8,982,400.00.

WHEREAS, on July 13, 2022, the Municipal Council adopted Resolution 7R1-n authorizing the Department of Public Works, Division of Public Buildings to enter into a contract with Pro Cops Security, LLC, 60 Park Place, Suite 1110, Newark, New Jersey 07102, to provide surveillance and protection of the interior and exterior of authorized City locations (Armed Security Guards) as described in the attached bid proposal at an amount not to exceed Eight Million Four Hundred Thousand Dollars and Zero Cents ($8,400,000.00), for a period not to exceed twenty-four (24) consecutive months; and
WHEREAS, the Department of Public Safety, Division of Police notified the Division of Central Purchasing of their desire to amend the contract with Pro Cops Security, LLC, 60 Park Place, Suite 1110, Newark, New Jersey 07102, to utilize the contract to add additional staffing of security guards and additional locations for an increase of cost Five Hundred Eighty-Two Thousand Four Hundred Dollars and Zero Cents ($582,400.00) for a new total contract amount not to exceed Eight Million Nine Hundred Eighty-Two Thousand Four Hundred Dollars and Zero Cents ($8,982,400.00); and
WHEREAS, all other contract terms and conditions will remain the same.
NOW, THEREFORE, BE IT RESOLVED BY THE MNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R1-n adopted on July 12, 2022 authorized the Department of Public Safety/Division of Police to enter into contract with Pro Cops Security, LLC, 60 Park Place, Suite 1110, Newark, New Jersey 07102, whose bid was received on the advertised due date and determined to be the lowest responsive responsible bidder in accordance with the bid specifications. The term of the contract January 1, 2023 through December 31, 2024.
2. This contract shall increase by an amount not to exceed Five Hundred Eighty Two Thousand Four Hundred Dolls and Zero Cents ($582,400.00) for and increased total contract amount not to exceed Eight Million Nine Hundred Eighty-Two Thousand Four Hundred Dollars and Zero Cents ($8,982,400.00).
3. This contract shall be ratified to January 1, 2023 through December 31, 2024 from the date of the adoption of this amending Resolution.
4. There shall be no amendment to change of this contract without the approval of the Municipal Council by Resolution.
5. There shall be no advance payment on this contract in accordance with N.J.S.A. 40:5-30.5.5(d)(2).
6. This is an open-ended contract to be used as needed during the term of the contract. Thus, for any and all expenditures against this contract, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from Account Code Line 2021 Budget/Department of Public Works, Division of Public Buildings/NW011-060-0604-71630-B2021, Department of Public Safety, Division of Police/NW011-200-2001-71630-B2024, this contract shall not exceed Eight Million Nine Hundred Eighty-Two Thousand Four Hundred Dollars and Zero Cents ($8,982,400.00) for one (1) vendor for the term January 1, 2023 through December 31, 2024.
7. The Interim Qualified Purchasing Agent, QPA, shall file a copy of the Resolution and the duly executed copy of the contract in the Office of the City Clerk.
8. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution ratifies, authorizes, and amends Resolution 7R1-n adopted on July 13, 2022, to include the Department of Public Safety, Division of Police as an authorizing department on the contract with Pro Cops Security, LLC, 60 Park Place, Suite 1110, Newark, New Jersey 07102 and increase the contract by an amount not to exceed $582,400.00, for a new total contract amount not exceed $8,982,400.00. This contract shall be ratified to January 1, 2023 through December 31, 2024, from the date of adoption of this amending Resolution.
