WHEREAS, on November 8, 2012, through Resolution Number 7R3-c, the Municipal Council of the City of Newark authorized the Mayor to accept certain WorkFirst New Jersey ("WFNJ") funds, more specifically, $662,853.00 in "Temporary Assistance for Needy Families" ("TANF") funds and $553,551.00 in "General Assistance/Supplemental Nutrition Assistance Program" ("GA/SNAP") funds (copies of the Resolution and the Notice of Obligation and Award letter from the State of New Jersey are attached hereto and made a part hereof); and
WHEREAS, there is a need for NewarkWORKS to enter into a contract with an entity that can provide training services to fifteen (15) GA/SNAP clients relative to working as Teacher Assistants, for the period of March 5, 2013, through June 30, 2013; and
WHEREAS, on September 26, 2012, NewarkWORKS advertised a Request for Proposal, which was returnable on October 24, 2012, for the above-referenced training services under the provisions of WFNJ for Program Year 2012-2013 (a copy of the Request for Proposal is attached hereto and made part thereof); and
WHEREAS, on October 24, 2012, NewarkWORKS received proposals from twenty-six (26) entities representing ninety-one (91) different training programs which were opened and entered on the tab sheet, a copy of which is attached; and
WHEREAS, the proposal received from Programs for Parents, Inc., 500 Bloomfield Avenue, Montclair, New Jersey 07042, was reviewed by a selection committee consisting of individuals from outside partnering agencies and was found to be the most advantageous to the City of Newark based upon price, experience and all other criteria stated in the RFP; and
WHEREAS, the Municipal Council of the City of Newark hereby authorizes and ratifies the use of competitive contracting for processing and awarding these WFNJ programs from September 26, 2012, to the date of adoption of this resolution, and authorizes its use in the future; and
WHEREAS, NewarkWORKS wishes to enter into a contract with Programs for Parents, Inc., to provide the above-referenced training services effective March 5, 2013, to June 30, 2013, in an amount not to exceed $45,000.00, for Program Year 2012-2013; and
WHEREAS, this contract is being awarded pursuant to State and Local Public Contract Law, including N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40a:11-5 and/or training services pursuant to N.J.S.A. 40A:11-5(1)(q) (as applicable), and the WFNJ; and
WHEREAS, this contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law (N.J.S.A. 19:44A-20.5); and
WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 ("Pay-to-Play Executive Order"), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee(s), the Deputy Mayor/Director of the Department of Economic and Housing Development and Acting Deputy Director of NewarkWORKS, are hereby authorized to enter into and execute a contract with Programs for Parents, Inc., 500 Bloomfield Avenue, Montclair, New Jersey 07042, to provide training to fifteen (15) GA/SNAP clients to work as Teacher Aides under WFNJ for Program Year 2012-2013, for the contract period of March 5, 2013, to June 30, 2013, for an amount not to exceed $45,000.00.
2. The Municipal Council of the City of Newark hereby ratifies the contract from March 5, 2013, to the date of adoption of this authorizing resolution.
3. The Municipal Council of the City of Newark hereby authorizes and ratifies the use of competitive contracting for processing and awarding these Work First New Jersey (WFNJ) programs from September 26, 2012, to the date of adoption of this resolution, and authorizes its use in the future.
4. This contract is subject to availability of funds from State of New Jersey, Department of Labor and Workforce Development.
5. Attached hereto is a certification of funds from the Municipal Comptroller, City of Newark Finance Department, which states (1) that there are sufficient funds in the amount of $45,000.00 for the purpose set forth hereinabove and (2) that the line appropriation of the official budget which shall be charged is Bus. Unit NW051, Dept. G13, Div./Proj. M1340, Activity A, Account 72060, Budget B2013.
6. There shall be no advance payments made on this contract.
7. There shall be no amendments or changes to this contract without approval from the City of Newark Municipal Council.
8. The Acting Deputy Director of NewarkWORKS shall file forthwith a copy of the fully executed contract in the Office of the City Clerk, which shall be made available for public inspection.
9. This contract is being awarded to a non-profit organization and as such is not governed by the State Pay-to-Play Law, N.J.S.A. 19:44A-205.5, or Newark Executive Order on Pay to Play Reform, MEO-07-0001.
STATEMENT
Resolution ratifies and authorizes the Mayor, and/or his designee(s), the Deputy Mayor/Director of the Department of Economic and Housing Development and Acting Deputy Director of NewarkWorks, to enter into and execute a contract with Programs for Parents, Inc., 500 Bloomfield Avenue, Montclair, New Jersey 07042, pursuant to the provisions of WFNJ, to provide training services to fifteen (15) GA/SNAP clients to work as Teacher Assistants, for a total cost not to exceed $45,000.00, and with a contract period beginning on March 5, 2013, and ending on June 30, 2013.
