WHEREAS, the State of New Jersey Department of Transportation's ("NJDOT") Fiscal Year 2026 State Aid to Municipal Aid Program (the "NJDOT Municipal Aid Program") provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and
WHEREAS, the City of Newark (the "City") needs to improve various roads throughout the City needing various issues attended to, including drainage improvements, installation of Americans with Disabilities Act compliant ramps, resurfacing, improving crosswalks and pavement markings; and
WHEREAS, the City desires to further the public interest by obtaining funding from the NJDOT Municipal Aid Program for the Project submitted by the City, identified by the City's file name: "MA-2026 - Five Ward Paving Improvement Project-00620 (the, "City Road Project"). The roads are located in all five wards within the City as set forth in detail in the list below;

WHEREAS, on or about June 30, 2025, on behalf of the City, the Acting Director of the Department of Engineering submitted an application to NJDOT requesting grant funding in the amount of One Million, Seven Hundred Forty Thousand, Two Hundred Seventy-Three Dollars and Zero Cents ($1,740,273.00) from the NJDOT Municipal Aid Program for street resurfacing within the City of Newark, identified as the "City Road Project," for the City of Newark with no City funds required; and
WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a Resolution from the Municipal Council authorizing submission of the grant application; and
WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Acting Director of the Department of Engineering desires to accept the grant award and execute a Grant Agreement governing said award; and
WHEREAS, upon notification of the receipt of a grant award in connection with this application for the City Road Project for the City of Newark, the Acting Director of the Department of Engineering shall submit a copy of the Grant Agreement to the City Clerk, Corporation Counsel and the Business Administrator for review, approval, and signature.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering are hereby authorized to submit an electronic grant application identified as MA-2026 Five Ward Paving Improvement Project - 00620, (the "City Road Project") on behalf of the City of Newark to the New Jersey Department of Transportation requesting grant funding in the amount of One Million, Seven Hundred Forty Thousand, Two Hundred Seventy-Three Dollars and Zero Cents ($1,740,273.00) from the NJDOT Municipal Aid Program (a copy of the application is attached hereto and made a part hereof).
2. The Municipal Council of the City of Newark recognizes and accepts that the Department may offer a lesser or greater amount and therefore, upon receipt of the grant agreement from the New Jersey Department of Transportation, does further authorize the execution of any such grant agreement upon review, approval and signature by the City's Mayor and Corporation Counsel; and also, upon receipt of the fully executed agreement from the Department, does further authorize the acceptance of the grant funds and the expenditure of the funds pursuant to the terms of the agreement between the City of Newark and the New Jersey Department of Transportation.
3. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing Resolution.
4. Upon notification of the receipt of a grant award in connection with this application, the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with NJDOT to receive and expend the grant award from the NJDOT Municipal Aid Program for The City Road Project
5. Upon notification of the receipt of a grant award in connection with this application, the Acting Director of the Department of Engineering shall submit a complete copy of the Grant Agreement and any associated documents to the City Clerk, Corporation Counsel and the Business Administrator for review, approval, and signature.
6. No municipal funds are required for receipt or acceptance of this grant award.
7. The Acting Director of the Department of Engineering shall file a fully executed copy of the grant application, grant award letter, and grant agreement in the Office of the City Clerk.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to submit an electronic grant application for, accept, and enter into an agreement for grant funding in the amount of One Million, Seven Hundred Forty Thousand, Two Hundred Seventy-Three Dollars and Zero Cents ($1,740,273.00) from the NJDOT Municipal Aid Program the City Road Project. No municipal funds are required.
