WHEREAS, the New Jersey “Clean Communities and Recycling Act” of 1981, created the Municipal Recycling Tonnage Grant Program, whereby municipalities could receive a grant for the amount of materials documented as being recycled during the previous calendar year; and

 

WHEREAS, in 1987, the New Jersey “Mandatory Source Separation and Recycling Act,” specifically N.J.S.A. 13:1E-99.16, mandated that municipalities submit an annual Recycling Tonnage Report summarizing the amount of material recycled during the previous calendar year; and

 

WHEREAS, in January 2008, the “Recycling Enhancement Act,” specifically N.J.S.A. 13:1E-96.b(1) reestablished the State of New Jersey Recycling Fund as a non-lapsing, revolving fund, administered by the New Jersey Department of Environmental Protection (“NJDEP”), from which a tonnage grant may be provided to municipalities in order to encourage local source separation and recycling programs; and

 

WHEREAS, the Municipal Recycling Tonnage Grant Program does not require the submission of an official application to receive an award nor does the NJDEP issue official award letters, rather grant funds are provided to the City via direct deposit; and

 

WHEREAS, in order to remain eligible for a direct recycling grant, municipalities need only submit an annual recycling tonnage report to the NJDEP for the previous calendar year’s recycling; and

 

WHEREAS, on April 16, 2017, the City of Newark, caused a 2017 annual Recycling Tonnage Report to be filed with the NJDEP (see “Tonnage Report” attached hereto and made a part hereof); and

 

WHEREAS, on or about December 24, 2019, the NJDEP issued a check for the 2017 Recycling Tonnage Grant funds awarded to the City in the amount of $220,124.44, which was directly deposited into the City’s account on February 7, 2020 (see “Deposit Summary” report attached hereto and made a part hereof); and

 

WHEREAS, the Director of Public Works, wishes to accept said 2017 Recycling Tonnage Grant funds; and

 

WHEREAS, no grant agreement is required in order to accept the 2017 Recycling Tonnage Grant funds; and

 

WHEREAS, no matching municipal funds are required for acceptance of the 2017 Recycling Tonnage Grant funds; and

 

WHEREAS, there is no timeframe for which the City may expend Tonnage Grant Funds as long as all recycling tonnage grant monies received are expended only for the City’s Recycling Program, pursuant to the Recycling Enhancement Act.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Public Works, are hereby authorized to submit its 2017 annual Recycling Tonnage Report with the New Jersey Department of Environmental Protection (“NJDEP”), for use for the City’s Recycling Program (a copy of the “Tonnage Report” is attached hereto and made a part hereof).

 

2.                     The Municipal Council hereby ratifies its authorization of the submission of the annual Recycling Tonnage Report from April 26, 2019 to the date of adoption of this authorizing resolution.

 

3.                     The Mayor and/or his designee, the Director of the Department of Public Works, are hereby authorized to accept the 2017 Recycling Tonnage Grant in the amount of $220,124.44 from the NJDEP for use for the City’s Recycling Program (a copy of the “Deposit Summary” report is attached hereto and made a part hereof).

 

4.                     The acceptance of the 2017 Recycling Tonnage Grant from the NJDEP is hereby ratified from December 24, 2019, to the date of adoption of this authorizing resolution.

 

5.                     No grant agreement is required in order to accept the 2017 Recycling Tonnage Grant funds; and

 

6.                     No matching municipal funds are required for acceptance of the 2017 Recycling Tonnage Grant funds; and

 

7.                     There is no timeframe for which the City may expend the 2017 Tonnage Grant Funds as long as all recycling tonnage grant monies received are expended only for the City’s Recycling Program, pursuant to the Recycling Enhancement Act.

 

8.                     The Director of the Department of Public Works shall file a fully-executed copy of the 2017 annual Recycling Tonnage Report, and the “Deposit Summary” report from the NJDEP in the Office of City Clerk.

 

 

STATEMENT

 

This resolution ratifies and authorizes: (1) the actions taken by the City of Newark to submit the 2017 annual Recycling Tonnage Report with the NJDEP, and; (2) the Director of the Department of Public Works to accept the 2017 Recycling Tonnage Grant funds in the amount of $220,124.44 from the NJDEP for use for the City’s Recycling ProgramNo municipal funds are required.  The funds do not need to be expended within a specific time frame as long as the funds are used for the City’s Recycling Program.
