Additional Information:

NJDOT will perform the resurfacing at no cost to the City of Newark.

WHEREAS, the City of Newark (the “City”) wishes to improve its streets for the traveling public and its residents alike; and

 

WHEREAS, the New Jersey Department of Transportation (“NJDOT”) has offered to resurface portions of South Street and Delancy Street within the City of Newark (the “City”) as part of its statewide maintenance resurfacing program; and

WHEREAS, pursuant to N.J.S.A. 27:7-15 and 27:7-16, the NJDOT is authorized to enter into agreements with municipalities for roadway resurfacing and maintenance; and

WHEREAS, the City of Newark has determined that said resurfacing work is necessary and in the public interest; and

WHEREAS, the attached Memorandum of Understanding (“MOU”) between the NJDOT and the City of Newark establishes the terms and responsibilities of each party, including that the NJDOT will fund and perform the resurfacing at no cost to the City; and

WHEREAS, the City’s Corporation Counsel has reviewed the MOU and found it legally sufficient and in proper form; and

WHEREAS, the City desires to authorize the execution of the MOU to enable the NJDOT to perform the resurfacing work prior to the onset of winter conditions;

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1.                     The Mayor and/or the Director of Engineering are hereby authorized to execute the attached Memorandum of Understanding between the City of Newark and the New Jersey Department of Transportation for the resurfacing of portions of South Street and Delancy Street.

 

2.                     No Changes shall be made to the terms and conditions of this Agreement without prior Municipal Council approval.

 

3.                     No municipal funds are required or will be spent under this Agreement or for this Project.

 

4.                     The Director of the Department of Engineering shall file a fully executed copy of the Memorandum of Understanding in the Office of the City Clerk.

 

5.                     A certified copy of this Resolution shall be forwarded to the New Jersey Department of Transportation, the City Engineer, and the Department of Public Works.

 

STATEMENT

 

This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering to enter into a Memorandum of Understanding with the New Jersey Department of Transportation for the resurfacing of portions of South Street and Delancy Street.
