WHEREAS, on June 17, 2013 the Department of Engineering, City of Newark, advertised for the receipt of sealed bids for Contract #14-2013, Renovations to the Educational Center, 111 Mulberry Street, Newark, New Jersey 07102, pursuant to the Local Public Contracts Laws, N.J.S.A. 40A:11-1 et seq.; and
WHEREAS, the seventeen (17) contractors, who picked up bid packages for Contract #14-2013, Renovations to the Educational Center, 111 Mulberry Street, Newark, New Jersey 07102, were invited to do a visual inspection of the building, on July 8, 2013; and
WHEREAS, on July 30, 2013, the scheduled date for the public opening of bids, nine (9) bids were received; and
WHEREAS, the bid submission of CCNY Corp., was rejected as materially defective as it did not comply with the required Women Business Entity or Minority Business Entity requirements of the bid specifications; and
WHEREAS, after a review of the bids received, the Director of the Department of Engineering, has determined that it is in the best interest of the City of Newark to accept the bid proposal and execute Contract #14-2013, Renovations to the Educational Center, 111 Mulberry Street, Newark, New Jersey 07102, with the lowest responsible bidder, Brahma Construction Corporation, 58 Wallington Avenue, Wallington, New Jersey 07057, in the total bid amount of One Million, Fifty-One Thousand and Sixty-Nine Dollars ($1,051,069.00) (Base Bid of $978,069.00 + Allowance + Alternates 1-3)
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Engineering, is hereby authorized on behalf of the City of Newark to accept the bid submitted by the lowest responsible bidder, Brahma Construction Corporation, 58 Wallington Avenue, Wallington, New Jersey 07057, and execute Contract #14-2013, Renovations to the Educational Center, 111 Mulberry Street, Newark, New Jersey 07102, for an amount not to exceed One Million, Fifty-One Thousand and Sixty-Nine Dollars ($1,051,069.00) (Base Bid of $978,069 + Allowance + Alternates 1-3).
2. The term of the contract shall be one (1) year from the date of the issuance of a formal written Notice to Proceed by the Director of the Department of Engineering.
3. Pursuant to N.J.S.A. 40A:11-15(9), the term of this contract can be extended by a resolution of the Municipal Council for the time period authorized necessary to complete actual construction.
4. No amendment or modification to this contract is allowed without prior Municipal Council approval.
5. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of the Department of Engineering and/or his designee.
6. Attached hereto is a Certification of Funds issued by the Chief Financial Officer, City of Newark, which states that there are available sufficient legally appropriated funds in the amount of One Million, Fifty-One Thousand and Sixty-Nine Dollars ($1,051,069.00). for the purposes set forth hereinabove. .
7. This contract was advertised and awarded in compliance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.
8. This public bidding process under the Local Public Contracts Law,N.J.S.A. 40A:11-1, et seq.; complies with Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and is in compliance with the City of Newark Executive Order and Pay-to-Play (MEO-07-0001), effective March 31, 2007.
9. If required by the State Law, the city VClerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller May 7, 2008.
STATEMENT
This resolution hereby authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to accept the bid submitted by the lowest responsible bidder, Brahma Construction Corporation, 58 Wallington Avenue, Wallington, New Jersey 07057, and execute Contract #14-2013, Renovations to the Educational Center, 111 Mulberry Street, Newark, New Jersey 07102 , for an amount not to exceed One Million, Fifty-One Thousand and Sixty-Nine Dollars ($1,051,069.00) (Base Bid of $978,069 + Allowance + Alternates 1-3).
