Original Resolution 7R3-d, adopted on August 3, 2022, awarded a bid contract to JA Alexander, Inc., in a contract amount not to exceed $5,214,466.55, for the Citywide Streets 2022 Paving Project with a contract period of 365 calendar days from the date of a written Notice to Proceed dated September 14, 2022, with a declared contract period of September 14, 2022 through September 14, 2023.
This Resolution will authorize the City of Newark to enter into and execute a Change Order/Amendment #1 to Contract #2022-02 with JA Alexander, Inc. to extend the contract term through March 14, 2024.

WHEREAS, on August 3, 2022, the Municipal Council adopted Resolution 7R3-d, which authorized the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute Contract #2022-02 with JA Alexander, Inc., 130-158 JFK Drive, Bloomfield, New Jersey 07003, to provide Street Paving Citywide, for the total bid amount of Five Million Two Hundred Fourteen Thousand Four Hundred Sixty-Six Dollars and Fifty-Five Cents ($5,214,466.55); and
WHEREAS, the Director of the Department of Engineering declares that additional time is required to complete Contract #2022-02 due to unforeseen field conditions, additional roadway restoration and resurfacing, as well as citywide infrastructure maintenance; and
WHEREAS, the Director of the Department of Engineering desires to execute Change Order/Amendment No. 1 to Contract #2022-02 with JA Alexander, Inc., to extend the contract term through March 14, 2024, pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-15(9), with no additional funds required.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark, and/or his designee, the Director of the Department of Engineering, is hereby authorized to enter into and execute Change Order/Amendment No. 1 to Contract #2022-02, with JA Alexander, Inc., 130-158 JFK Drive, Bloomfield, New Jersey 07003, which will extend the term of the contract to March 14, 2024, with no additional funds required.
2. The Municipal Council hereby ratifies the contract amendment from September 14, 2023 to the date of adoption of this authorizing resolution.
3. All other terms and conditions of Contract #2022-02, Street Paving Citywide 2022, shall remain in force and effect until the contract is completed.
4. No further amendments or modifications to this amended contract shall be permitted without prior Municipal Council approval.
5. A fully executed copy of Change Order/Amendment No. 1 to Contract #2022-02, Street Paving Citywide, shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.

This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to enter into and execute Change Order/Amendment No. 1 to Contract #2022-02, Street Paving Citywide, with JA Alexander, Inc., 130-158 JFK Drive, Bloomfield, New Jersey 07003, to extend the contract term to March 14, 2024, with no additional municipal funds required.
