WHEREAS, on June 21, 2019, the City of Newark (the “City”) through its Purchasing Agent, QPA, advertised to solicit proposals for contractors to provide Homeless Outreach and Engagement Services for the Department of Health and Community Wellness, as described in the Request for Proposal (attached hereto); and
WHEREAS, the Division of Central Purchasing also distributed three (3) Request for Proposal (RFP) packages to prospective vendors following the date of advertisement; and
WHEREAS, the Division of Central Purchasing also published the RFP package on the City of Newark’s website to provide broader access and download capability to potential bidders; and
WHEREAS, on July 18, 2019 the Division of Central Purchasing received two (2) proposals in response to this advertisement; and
WHEREAS, the Evaluation Committee recommended that a single award be made to Bridges Outreach, Inc., 120 Morris Avenue, Summit, New Jersey 07901 based on price and other factors listed in the RFP; and
WHEREAS, the Purchasing Agent, QPA, concurs with the recommendation from the Evaluation Committee that a single award be made to Bridges Outreach, Inc., 120 Morris Avenue, Summit, New Jersey 07901; and
WHEREAS, on October 22, 2019, the Municipal Council adopted Resolution 7R1-a(S/AS) authorizing Bridges Outreach, Inc., 120 Morris Avenue, Summit, New Jersey 07901, to provide Homeless Outreach and Engagement Services for the Department of Health and Community Wellness, in an amount not to exceed One Hundred and Fifty-Five Thousand Dollars and Zero Cents ($155,000.00); and
WHEREAS, the contract amount authorized in 7R1-a(S/AS), One Hundred and Fifty-Five Thousand Dollars and Zero Cents ($155,000.00), is not sufficient enough to cover the Homeless and Outreach Engagement Services to be provided by Bridges Outreach, Inc., and was inconsistent with the amount submitted as part of its Proposal; and
WHEREAS, the anticipated Notice to Proceed date located within the RFP specifications has passed; and
WHEREAS, Bridges Outreach, Inc., has not commenced the performance of services pursuant to the previously approved contract; and
WHEREAS, the Purchasing Agent, QPA, recommends amending Resolution 7R1-a(S/AS) adopted on October 22, 2019 which awarded the contract to Bridges Outreach, Inc., 120 Morris Avenue, Summit, New Jersey 07901 by changing the contract amount to One Hundred Eighty-Two Thousand Four Hundred Eleven Dollars and Ninety-Four Cents $182,411.94 under this authorizing resolution; and
WHEREAS, the contract amount will increase to One Hundred Eighty-Two Thousand Four Hundred Eleven Dollars and Ninety-Four Cents ($182,411.94) to match the amount Bridges submitted in its Proposal; and
WHEREAS, the contract term will be twelve (12) consecutive months from the date of the Notice to Proceed; and
WHEREAS, pursuant to N.J.S.A. 40A:11-24, Bridges Outreach, Inc., has consented to holding their prices beyond sixty (60) days; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq., meets the requirements of the Fair and Open Process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Purchasing Agent, QPA, are hereby authorized to enter into and execute a contract with Bridges Outreach, Inc., 120 Morris Avenue, Summit, New Jersey 07901, to provide Homeless Outreach and Engagement Services for the City of Newark, Department of Health and Community Wellness, whose Proposal was received on the advertised due date and chosen as the proposal that best serves the City of Newark due to price and other factors. The term of the contract will be established for a period not to exceed twelve (12) consecutive months, from the date of the Notice to Proceed, pursuant to N.J.S.A. 40A:15.
2. Amend Resolution 7R1-a(S/AS) adopted on October 22, 2019, and award this contract with this authorizing resolution.
3. There shall be no amendment or change of this contract without the approval of the Municipal Council.
4. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Funds for 2019 and 2020 and subsequent years are contingent upon appropriations, pursuant to N.J.A.C. 5:30-5.5(d)(2).
5. This is an open-ended contract to be used as needed during the term of the contract. Thus, for any and all expenditures against this contract, a Certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from Account Code Line: NW011- 120-1205-71280-B2020. This contract shall not exceed One Hundred Eighty-Two Thousand Four Hundred Eleven Dollars and Ninety-Four Cents ($182,411.94) and not exceed twelve (12) consecutive months, from the date of the Notice to Proceed, for one (1) vendor.
6. The Purchasing Agent, QPA, shall file a duly executed copy of this contract in the Office of the City Clerk.
7. If required by State Law, the City Clerk shall provide the appropriate Notice of Award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

Resolution amending Resolution 7R1-a(S/AS) adopted on October 22, 2019 by the Municipal Council and authorizing the Mayor and/or his designee, the Purchasing Agent, QPA, to enter into and execute a contract with Bridges Outreach, Inc., 120 Morris Avenue, Summit, New Jersey 07901 to provide Homeless Outreach and Engagement services to the City’s Department of Health and Community Wellness at a cost not to exceed One Hundred Eighty-Two Thousand Four Hundred and Eleven Dollars and Ninety-Four Cents ($182,411.94) for a period of twelve (12) consecutive months from the date of the Notice to Proceed.
