WHEREAS, the City of Newark (the “City”) seeks to partner with emergency shelters that will provide temporary housing accommodations and supportive services to homeless Newark residents; and 

 

WHEREAS, pursuant to State Local Public Contracts Law, N.J.S.A. 40A:11-4.1(b)(2), the competitive contracting process may be used for the operation, management or administration of social service programs; and

 

WHEREAS, pursuant to the Fair and Open Process of State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, the City publicly advertised a Request for Proposal (RFP) on or about January 13, 2026, for Emergency Housing Program For Individuals and Families with all such proposals due on February 10, 2026; and

 

WHEREAS, the Proposal received from Isaiah House, 238 North Munn Avenue, East Orange, New Jersey 07017 (hereinafter referred to as “Vendor”), was advantageous to the City of Newark based on experience and all other criteria listed in the RFP; and

 

WHEREAS, the Director of the Department of Health and Community Wellness, Office of Homeless Services, desires to enter into a Contract with the Vendor for the purpose of providing Emergency Housing Program for Newark Residents Individuals and Families services for the contract period April 1, 2026 through March 31, 2027, in an amount not to   exceed Two Hundred Eighty-Four Thousand Seven Hundred Dollars and Zero Cents ($ 284,700.00),  with a partial award amount for the initial period of April 1, 2026 through May 31, 2026, of Forty-Seven Thousand Five Hundred Eighty Dollars and Zero Cents ($47,580.00) balance of the contract is subject to the availability of funds; and

 

WHEREAS, this Contract is awarded to the Vendor, in compliance with Local Public Contracts Law, including but not limited to N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11-5, and Emergency Housing Program for Newark Residents Individuals and Families; and

 

 

WHEREAS, the Municipal Council of the City of Newark deems it to be in the best interest of the City to enter into a contract with Vendor for the provision of emergency housing for the Emergency Housing Program for Newark Resident Individuals and Families.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, Office of Homeless Services, are hereby authorized to enter into and execute a Contract with Isaiah House, 238 North Munn Avenue, East Orange, New Jersey 07017 (hereinafter referred to as “Vendor”), for the period April 1, 2026 through March 31, 2027, in an amount not to exceed  Two Hundred Eighty-Four Thousand Seven Hundred Dollars and Zero Cents ($ 284,700.00),  with a partial award amount for the initial period of April 1, 2026 through May 31, 2026, of Forty Seven Thousand Five Hundred Eight Dollars and Zero Cents ($47,580.00)  , to provide Emergency Housing Program services, which are further described in the “Scope of Services” attached hereto and made a part of this Agreement.

 

2.                     The terms of this Contract may only be waived or amended in writing and signed by the parties duly authorized to execute this Contract, subject to the approval of the Newark Municipal Council by Resolution. The term of this Contract may be extended for up to two (2) 6-month periods, provided that any such extension is at no additional cost to the City, is authorized by Resolution of the Newark Municipal Council including a finding that the services are being performed in an effective and efficient manner; and is in writing signed by both parties.

 

3.                     The Municipal Council of the City of Newark hereby ratifies the use of competitive contracting for processing Emergency Housing Program for Newark Residents Individuals and Families from February 10, 2026, to the date of adoption of this authorizing Resolution and authorizes its use in the future.

 

4. The Contract between the City of Newark and Vendor is hereby ratified from April 1, 2026, to the date of adoption of this authorizing Resolution.

 

5.                     Pursuant to N.J.A.C. 5:30-5.5, attached hereto is Comptroller’s partial certification, which states that funds in the amount of Forty-Seven Thousand Five Hundred Eighty Dollars and Zero Cents ($47,580.00), are available in the 2026 Temporary Budget Under Business Unit: NW011, Department X, Div/Proj. X, Activity X, Account #97550 Budget Ref B2026 in the aforementioned Health and Community Wellness Department. All Certification of Funds shall be filed along with the original Resolution in the Office of the City Clerk. Funding beyond the Temporary Budget is subject to the availability and appropriation of funds. After adoption of the 2026 Budget, a certificate of availability of funds shall be prepared for the remaining balance of the entire contract and same shall be filed together with this Resolution in the Office of the City Clerk.

 

6.                     This Contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law, N.J.S.A 19:44A-20.5, State Local Public Contracts Law, including, but not limited to N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11-5, and Emergency Housing Program for Newark Residents Individuals and Families.

 

 

7.                     An executed copy of said Contract shall be filed with the Office of the City Clerk by the Director of the Department of Health and Community Wellness, Office of Homeless Services.

 

STATEMENT

 

                     This Resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Health and Community Wellness/ Office of Homeless services, to enter into an Agreement with Isaiah House, 238 North Munn Avenue, East Orange, New Jersey 07017, for the period of  April 1, 2026 through March 31, 2027, in an amount not to exceed  Two Hundred Eighty-Four Thousand Seven Hundred Dollars and Zero Cents ($ 284,700.00),  with a partial award amount for the initial period of April 1, 2026 through May 31, 2026, of Forty Seven Thousand Five Hundred Eight Dollars and Zero Cents ($47,580.00), subject to the availability of funds.
