AN ORDINANCE AMENDING TITLE XXXII, SEWERS AND SEWAGE DISPOSAL, CHAPTER 2, PUBLIC SEWERS; GENERAL PROVISIONS, SECTION 32:2-9(e), SEWER CONNECTION FEE, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, BY AMENDING THE CONNECTION FEE RATES.

WHEREAS, on September 8, 2022, the Municipal Council adopted, Ordinance 6PFS-e authorizing revisions to the water connection fees based upon recommendations from NW Financial Group, LLC (“NW Financial”), as a result of a study of the capital costs and interest on debt service together with the number of equivalent users, pursuant to N.J.S.A. 40A:26A-11.2, which requires an annual study of capital costs and interest on debt service; and

 

WHEREAS, after the 2024 annual computation of the connection fees NW Financial recommends adjustments of the connection of Sewer Fees; and

 

WHEREAS, the Mayor of the City of Newark, the Director of the Department of Water and Sewer Utilities and Director of the Department of Finance concur with the recommendations of NW Financial and desire to amend the Sewer Connection Fee Ordinance.

 

NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:

SECTION 1.Title XXXII, Sewers and Sewage Disposal, Chapter 2, Public Sewers: General Provisions, Section 32:2-9, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, is hereby amended as follows:

 

§ 32:2-9 SEWER CONNECTION FEE.

 

e.  Before a building permit is issued for new construction under the Uniform Commercial Code or a permit is requested for a new or enlarged connection to any sewer main under municipal control, there shall be paid to the Department of Water and Sewer Utilities the following one-time connection fees:

*Based on estimated average daily flow of sewer for the connector divided by the average daily flow of water for the average single family residence within the City.

 

SECTION 2. If any portion of this ordinance shall be deemed unenforceable by a court of competent jurisdiction, the remainder of the ordinance shall remain in full force and effect.

 

SECTION 3. The Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.

 

SECTION 4.  Codification. This Ordinance shall be a part of the Code of the City of Newark as though codified and fully set forth therein. The City Clerk shall have this Ordinance codified and incorporated in the official copies of the Code. The City Clerk and the Corporation Counsel are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Newark in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed.

 

 

STATEMENT

 

 

This Ordinance amends Title XXXII, Water, Chapter 2, Public Sewers; General Provisions, Section 32:2-9(e), Sewer Connection Fee, by amending the connection fee rates.
