Emergency Contract #E2025-04 for the period February 27, 2025 through May 27, 2025 was awarded for the Office of Administration, in an amount not to exceed $600,000.00. This extension of Emergency Contract #E2025-04 will be for an additional (90) days.

WHEREAS, on February 27, 2025, the Office of Administration requested a declaration of emergency for immediate furnishing of two hundred (200) units to provide housing to eligible unhoused families transitioning into homes in partnership with the Newark Housing Authority. Furnishing and occupying newly renovated homes will prevent risks of burglary, adding safety to the community and protecting vital housing resources; and
WHEREAS, on February 27, 2025, the Purchasing Agent accepted the emergency declaration to provide for the furnishing of two hundred (200) unoccupied newly renovated units resulting in contracts with Cort, A Berkshire Hathaway Company 5 Route 17 South, Hasbrouck Heights, NJ 07604 and Home Décor Furniture Newark 469 Springfield Avenue Newark, NJ 07103 (“contractor”), in an amount not to exceed Six Hundred Thousand Dollars and Zero Cents ($600,000.00); and
WHEREAS, Emergency Contract #E2025-04 was originally awarded on February 27, 2025 for a period of ninety (90) days ending May 27, 2025, and subsequently extended by resolution through August 26, 2025; and
WHEREAS, the Office of Administration now requests a second ninety (90) day extension of Emergency Contract #E2025-04 to cover the period August 27, 2025 through November 25, 2025; and
WHEREAS, the emergency conditions necessitating the original declaration remain, as unfurnished units continue to pose safety risks to property and public welfare; and
WHEREAS, N.J.S.A. 40A:11-6 provides that emergency contracts may be entered into when emergency situations arise that could potentially the health, safety and welfare or residents; and
WHEREAS, the Office of Administration desires ratification and authorization for a second extension of Emergency Contract #E2025-04 for the period commencing from August 27, 2025 through November 25, 2025, for a total not-to-exceed contract amount of Six Hundred Thousand Dollars and Zero Cents ($600,000.00); and
WHEREAS, N.J.A.C. 5:34-6.1(a)(3) provides that the emergency purchasing procedure may be used when the need exists for immediate delivery of goods services related to exigencies or emergencies; and
WHEREAS, City Ordinance 6PSF-e adopted on April 6, 2011, Article 2:5-13.2 (E)(1)(b) and (c) limits the period of emergency contracts to ninety (90) days and precludes extensions of emergency contracts without authorization by the Municipal Council by Resolution; and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator, and/or the Purchasing Agent, QPA, are hereby authorized to execute an extension of Emergency Contract #E2025-04 with Cort, A Berkshire Hathaway Company 5 Route 17 South, Hasbrouck Heights, NJ 07604 and Home Décor Furniture Newark 469 Springfield Avenue Newark, NJ 07103, for the furnishing of two hundred (200) homes at an amount not-to-exceed Six Hundred Thousand Dollars and Zero Cents ($600,000.00).
2. The extension of Emergency Contract #E2025-04 is ratified from August 27, 2025 through the date of adoption of this Resolution. The expiration date is extended to November 25, 2025. Funds for this contract are available on budget account code NW026 3035 B2025
3. The City Purchasing Agent shall file copies of all documents related to Emergency Contract #E2025-04 with the Office of the City Clerk. Pursuant to ⸹2:5-13.2 of the City Code, the Purchasing Agent shall post the emergency contract on the City’s website within forty-eight (48) hours.
4. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution ratifies and authorizes the Mayor, and/or his designees, the Business Administrator and/or the Purchasing Agent, QPA, to extend Emergency Contract #E2025-04 with Cort, A Berkshire Hathaway Company 5 Route 17 South, Hasbrouck Heights, NJ 07604 and Home Décor Furniture Newark 469 Springfield Avenue Newark, NJ 07103, in an amount not to exceed Six Hundred Thousand Dollars and Zero Cents ($600,000.00), inclusive of all prior authorizations, with the extension effective August 27, 2025 through November 25, 2025.
