This Resolution authorizes the City of Newark to enter into Agreement Modification #1 to Federal Aid Cost Reimbursement Agreement #2022-DT-DLA-102 with the New Jersey Department of Transportation (NJDOT), to extend the contract term to June 30, 2026.

WHEREAS, the City of Newark, Department of Engineering has proposed to improve pedestrian and bicycle connections along Center Street and Park Place between Broad Street and McCarter Highway (Route 21); and
WHEREAS, Resolution 7R4-D, adopted on October 21, 2015, authorized the City of Newark to accept $4.7 million dollars in grant funding from the New Jersey Department of Transportation (NJDOT) for the Route 21, Newark Riverfront Pedestrian and Bicycle Access project, with $498,000.00 of which to be allocated toward the Concept Development Stage of the project; and
WHEREAS, on September 1, 2022, the City of Newark entered into Federal Aid Cost Reimbursement Agreement #2022-DT-DLA-102 with NJDOT, for the Route 21, Newark Riverfront Pedestrian and Bicycle Access - Concept Development Study project, with a contract period of September 1, 2022 through December 31, 2024; and
WHEREAS, on April 18, 2024, without the need for application, the City received Agreement Modification No. 1 to Federal Aid Cost Reimbursement Agreement #2022-DT-DLA-102 (a copy the Agreement Modification is attached hereto and made a part hereof) from NJDOT extending the project until June 30, 2026; and
WHEREAS, the City wishes to appoint the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering to act as the authorized person to execute the Agreement Modification No. 1 to Federal Aid Cost Reimbursement Agreement #2022-DT-DLA-102, which will extend the contract term until June 30, 2026 for the City of Newark, Route 21, Newark Riverfront Pedestrian and Bicycle Access - Concept Development Study project.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to accept from the New Jersey Department of Transportation (NJDOT) an extension of the grant contract term to June 30, 2026 for the Route 21, Newark Riverfront Pedestrian and Bicycle Access - Concept Development Study project.
2. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering are hereby authorized on behalf of the City of Newark to enter into and execute Agreement Modification No. 1 to Federal Aid Cost Reimbursement Agreement #2022-DT-DLA-102 to accept the extension of the grant contract to June 30, 2026 for the City of Newark, Route 21, Newark Riverfront Pedestrian and Bicycle Access- Concept Development Study Project between the City of Newark and New Jersey Department of Transportation.
3. The Acting Director of the Department of Engineering shall file a fully executed copy of the grant agreement in the Office of the City Clerk.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering to accept an extension of the contract term for Federal Aid Cost Reimbursement Agreement #2022-DT-DLA-102 from the New Jersey Department of Transportation for the Route 21, Newark Riverfront Pedestrian and Bicycle Access - Concept Development Study project, until June 30, 2026.
