WHEREAS, the City of Newark recognizes the financial hardship that has affected property owners, homeowners and businesses alike, the Administration and Municipal Council recognizes that there is a need to assist by offering a short term, ninety (90) day Amnesty Program; and
WHEREAS, the Administration and Municipal Council desires to set forth an Interest/Amnesty Program (the “Amnesty Program”) for delinquent water/sewer charges only, for the year(s) 2023 and prior, which will authorize the Director of the Department of Water and Sewer Utilities and the Tax Collector to waive accrued interest only on said charges for the period August 1, 2024 through October 31, 2024 only; and
WHEREAS, this Amnesty Program applies to interest only accrued on delinquent water and sewer charges; and
WHEREAS, this Amnesty Program does not include:
• Third party lienholders, purchased or assigned;
• Bankruptcy Accounts or any other litigated matters, pending or settled;
• Funds such as interest, penalties, premiums or fees that may be due to a third party lien holder purchased or assigned;
• Any properties acquired, transferred, purchased, or negotiated through any Federal, Civil, Municipal, State or Superior Court; and
• Any property redeemed from a Municipal Foreclosure.
WHEREAS, to receive benefit of the Amnesty Program, payments must be for the entire delinquent amount due, there will be no exceptions. Payment will be accepted by Certified Bank Funds, Bank or Postal Money Orders, or Cash Only. Credit or Debit Cards is not accepted. Partial Payments will not receive benefit of this Amnesty Program.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Director of the Department of Water and Sewer Utilities, and the Tax Collector are hereby authorized to commence with an Amnesty Program by waiving interest only on delinquent charges for the years 2023 and prior for the period August 1, 2024 through October 31, 2024.
2. Upon expiration of this Amnesty Program, interest will be assessed without regard to the Amnesty Program, and return to the set rate respectively, and calculated from the original due date to the date of payment.
3. This Resolution is ratified and the Amnesty Program shall take effect on August 1, 2024 and end October 31, 2024, and will not be extended or amended.
4. The Director of the Department of Water and Sewer Utilities and the Tax Collector are hereby authorized to do all things necessary to accomplish this task.

This Resolution authorizes and ratifies an Amnesty Program, by waiving the interest accrued on delinquent water and sewer charges for the years 2023 and prior for the period August 1, 2024 through October 31, 2024 only.
