WHEREAS, pursuant to Resolution 7R1-F(S), authorized on December 22, 2009, the City of Newark appropriated $40,000.00 in Community Development Block Grant (CDBG) funds to the Boys & Girls Club of Newark, (hereinafter referred to as the Sub-recipient) to provide physical rehabilitation services to its' facility located at 500 Broad Street, Newark, New Jersey; and
WHEREAS, pursuant to Resolution 7R1-F, authorized on January 19, 2011, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute a contract with the Sub-recipient for the purpose of performing physical rehabilitation for the contract period January 1, 2010 through December 31, 2010, in an amount not to exceed $40,000.00; and
WHEREAS, the Sub-recipient has requested authorization to extend the contract period to complete this project from January 1, 2010 through December 31, 2010 to January 1, 2010 through December 31, 2012; and
WHEREAS, the Sub-recipient has also requested authorization to change the scope of services from fence installation, roof repair and repaving the parking lot to HVAC repair at the same location; and
WHEREAS, this project does not require the use of additional funds and all other terms and conditions contained in the contract authorized under Resolution 7R1-F011911 shall remain in full effect.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a First Amended Sub-recipient Agreement, in the form attached hereto with the Boys & Girls Club of Newark, 500 Broad Street, Newark, NJ, 07102, (hereafter referred to as the Sub-recipient), which will amend the term of the Sub-recipient Agreement from January 1, 2010-December 31, 2010 to January 1, 2010-December 31, 2012, to allow the Sub-recipient to complete the project and amend the scope of services from fence installation, roof repair and repaving the parking lot to HVAC repair at the same location.
2. The First Amended Sub-recipient Agreement between the City of Newark and the Sub-recipient is hereby ratified from January 1, 2010 to the date of adoption of this authorizing resolution.
3. This resolution and a fully executed copy of the First Amended Sub-recipient Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
4. This project does not require the use of additional funds and all other terms and conditions contained in the Agreement authorized pursuant to Resolution 7R1-F011911 shall remain in full effect and in accordance with the law.

This is a resolution ratifying and authorizing the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute a First Amended Sub-recipient Agreement in the form attached hereto with the Boys & Girls Club of Newark, 500 Broad Street, Newark, NJ, 07102, amend the term of the Sub-recipient Agreement from January 1, 2010 through December 31, 2010 to January 1, 2010 through December 31, 2012, to allow the Sub-recipient to complete the project and amend the scope of services from fence installation, roof repair and repaving the parking lot to HVAC repair for its' facility located at 1 Avon Avenue, Newark, New Jersey, Block 2590, Lot 1/Central.
