WHEREAS, a suit was instituted in the Superior Court of New Jersey, County of Essex, bearing Civil Action Docket Number ESX-L-5368-06, seeking recovery for personal injury damages suffered by Plaintiff Roland Michael Dancy as a result of a negligence on the part of Newark Police Officer Irving Cornell and vicarious liability on the part of the City of Newark; and
WHEREAS, a proposal has been made to resolve said litigation by payment in the amount of Three Hundred Thousand Dollars and Zero Cents ($300,000.00); and
 
WHEREAS, the Corporation Counsel based upon all facts and circumstances deems it in the best interest of the City of Newark to pay the legal services.
 
      NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Director of Finance is hereby authorized and directed to issue a check in the amount of Three Hundred Thousand Dollars and Zero Cents ($300,000.00) made payable to "Hunt, Hamlin & Ridley, LLC" who shall act as custodian and distributor of the settlement funds of Roland Michael Dancy and his attorney Kenneth Mangano, Esq. of the law firm of Ferro, Kuba, Mangano, Skylar, Gacovino & Lake, P.C., 21 Penn Plaza, 360 West 31st Street, Suite 1100, New York, New York 10001, upon receipt by the Corporation Counsel of all documents deemed necessary.                                                                
    1. Annexed hereto is the Certification of the Comptroller of the City of Newark which states that there are available sufficient legally appropriated funds from Fund 025, Agency 25t, Organization 5t25 and Object 96320, for the purpose set forth hereinabove.  A copy of the Comptroller's Certification shall be filed in the Office of the City Clerk along with this Resolution by the Corporation Counsel.
 
STATEMENT
      The purpose of the within Resolution is the settlement of Civil Litigation, filed by Plaintiff Ronald Michael Dancy, Ronald Michael Dancy v. City of Newark, et. al., ESX-L- 5368-06, in the amount of Three Hundred Thousand Dollars and Zero Cents ($300,000.00).
