WHEREAS, the United States Department of Justice , Office of Juvenile Justice and Delinquency Prevention (“USDOJ”) made funds available through its Community-Based Violence Prevention Demonstration Program (“CBVPD”), which encouraged cities to develop community-based strategies to reduce crime, violence and recidivism; and
 
WHEREAS, on May 23, 2011, the Newark Police Department (“NPD”) in partnership with the Office of Reentry, an initiative of the Department of Economic and Housing Development (“DEHD”), submitted an application to the USDOJ for CBVPD Program grant funds in the amount of $ 2,196,085.00 for the Newark Hotspot Initiative (“Hotspot”); and
 
WHEREAS, on August 31, 2011, USDOJ awarded the City a $2,196,085.00 grant and has approved a budget that includes expenditures of $216,000.00 for Transitional Employment Services for 120 “at-risk” young adults, ages 18 to 30; and
 
WHEREAS, through Resolution 7R3-a(s), adopted June 12, 2012, the City of Newark Municipal Council ratified and authorized the NPD, in partnership with the Office of Reentry of DEHD, to prepare an application to USDOJ for grant funding in the amount of $2,196,085.00 for Hotspot and
 
further authorized the NPD and DEHD to accept said grant funds and enter into a cooperative agreement with USDOJ, for the grant award 2011-PB-FX-K001, in the amount of $2,196,085.00, for Hotspot, for the period commencing on October 1, 2011 and terminating on September 30, 2014; and
 
WHEREAS, on January 4, 2013  the NPD and DEHD requested an extension of grant agreement from September 30, 2014 to December 31, 2015, through the submission of a Grant Adjustment Notice to USDOJ, which was approved by USDOJ on February 12, 2013; and
 
WHEREAS, DEHD, through the Office of Reentry, is in need of Transitional Employment Services to assist in the implementation and administration Hotspot; and
 
WHEREAS, pursuant to N.J.S.A. 40A:11-4.1(b) (2), a contract for such services may be awarded through a competitive contracting process; and
 
WHEREAS, the City of Newark issued a Request for Proposals (“RFP”) on January 17, 2012, subject to the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.4, to obtain proposals from vendors to provide Transitional Employment Services for 120 “at-risk” young adults, ages 18-30; and
 
WHEREAS, six (6) vendors, including the Greater Newark Conservancy (“Conservancy”), located at 32 Prince Street, Newark, NJ, 07103, submitted proposals (the “Proposals”) in response to the City's RFP; and
 
WHEREAS, the Proposals were reviewed and evaluated by staff from NPD, DEHD and the Business Administrator's Office (the “Review Committee”); and
 
WHEREAS, the City, based upon the Review Committee's review of all proposals and the high ranking of the Conservancy's proposal to the RFP and the Conservancy's prior experience and proven ability to serve at-risk individuals, the City desires to enter into a contract with the Conservancy in the amount of $216,000.00 for the purpose of providing Transitional Employment Services to 120 “at-risk” young adults, ages 18 to 30, for Hot Spot; and
 
WHEREAS, this contract is being awarded to a non-profit organization and as such is not governed by State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, or Newark Executive Order on Pay-to-Play Reform, MEO-07-0001; and
 
WHEREAS, the contract is funded solely through the Grant Award received from the USDOJ through its CBVPD Program.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development are hereby authorized to enter into and execute a Contract with the Greater Newark Conservancy (“Conservancy”), 32 Prince Street, Newark, New Jersey, 07103, for the purpose of providing transitional employment services to 120 “at-risk” young adults, ages 18 to 30, for the Newark Hot Spot Initiative, in an amount not to exceed $216,000.00, for the period commencing on January 15, 2013 and terminating on December 31, 2015.  
    2. The Municipal Council hereby ratifies its authorization of this Contract between the City of Newark and the Conservancy from January 15, 2013 to the date of adoption of this authorizing resolution.
    3. Attached hereto is a certification of funds from the Director of Finance of the City of Newark, which states that (1) there are available legally appropriated funds for the purpose set forth hereinabove in the amount of $216,000.00 and (2) that the line appropriation of the official budget which shall be charged is as follows:

    1. This contract is being awarded to the Conservancy pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.). Since the Conservancy is a non-profit organization, the procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and Newark Executive Order MEO-07-0001, effective March 31, 2007, do not apply.
    1. A copy of the certification of funds and the fully executed contract herein authorized shall be filed in the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
    1. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement as required by law within ten (10) days of its passage.
 
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his Designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a contract with the Greater Newark Conservancy, located at 32 Prince Street, Newark, New Jersey 07103, (“Conservancy”) for the purpose of providing transitional services to 120 “at-risk” young adults, ages 18 to 30, for the Newark Hot Spot Initiative, in an amount not to exceed $216,000.00, for the period commencing on January 15, 2013 and terminating on December 31, 2015. This contract is being awarded to the Conservancy pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.) and since the Conservancy is a non-profit organization the State Pay-to- Play Law, N.J.S.A. 19:44A-20.5, and Newark Executive Order MEO-07-0001 do not apply.
