         WHEREAS, the North Jersey Transportation Planning Authority (NJTPA) and the State of New Jersey, Department of Transportation (NJDOT) provide funds for Local Safety Programs; and
 
      WHEREAS, the City of Newark applied for grant funding to the North Jersey Transportation Planning Authority (NJTPA) from the FY 2013 Local Safety Program and the FY 2014 Local Safety Program; which applications were authorized and ratified and the grant awards accepted and ratified by Municipal Resolutions 7R4-A, February 6,2013 (Broad Street and South Street Pedestrian Safety Project) and 7R4-B, October 29, 2013 (Broad Street and Tichenor Street/Lincoln Park and Dr. Martin Luther King, Jr. Boulevard and 7th Avenue/Crane Street Project) , respectively; and
 
      WHEREAS, the NJTPA awarded the City of Newark the following funds for the projects listed below:

WHEREAS, on May 22, 2014,  the North Jersey Transportation Planning Authority (NJTPA), notified the City of Newark that the Broad Street and South Street (FY 2013 Local Safety Program), and Broad Street and Tichenor Street/Lincoln Park (FY 2014 Local Safety Program) projects are to be combined into one project, which will allow construction to occur simultaneously; and
 
WHEREAS, the revised project construction cost for the Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park Project is $1,436,194.00; and
 
WHEREAS, the revised project construction cost for the Dr. Martin Luther King, Jr. Boulevard and 7th Avenue/Crane Street Project is $991,983.00; and
 
WHEREAS, the City of Newark was also notified on May 22, 2014 by the North Jersey Transportation Planning Authority (NJTPA) that the City of Newark was eligible to use Federal Highway Safety Improvement Program (HSIP) funds for construction management and inspection services for the Broad Street and South Street, and Broad Street and Tichenor Street/Lincoln Park, and Dr. Martin Luther King, Jr. Boulevard and 7th Avenue/Crane Street Projects; and
 
WHEREAS, the City of Newark has been notified that it will receive $158,867.00 for construction management and inspection services for the Broad Street and South Street, and Broad Street and Tichenor Street/Lincoln Park Project; and
 
WHEREAS, the City of Newark has been notified that it will receive $158,233.00 for construction management and inspection services for the Dr. Martin Luther King, Jr. Boulevard and 7th Avenue/Crane Street Project; and
 
WHEREAS, the revised and combined grant awards for the projects are as follows:

      WHEREAS, no municipal funds are required for receipt or acceptance of this grant award; and
 
      WHEREAS, upon notification of final authorization of these projects from NJDOT, the Director of the Department of Engineering shall submit a copy of the authorization letter and the grant/project agreements to the Corporation Counsel and the Business Administrator for review, approval, and signature.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
    1. The Municipal Council hereby ratifies its authorization of the application for grant funding from the  FY 2013 and 2014 Local Safety Programs and the use of federal Highway Safety Improvement Program (HSIP) funds for construction management and inspection services for the now combined project of Broad Street and South Street & Broad Street and Tichenor Street/Lincoln Park ($158,867.00), and the Dr. Martin Luther King,  Jr. Boulevard & 7th Avenue/Crane Street ($158,233.00) from the date of submission to the date of adoption of this authorizing resolution.
    1. The revised grant award in the amount of $1,595,061.00 for Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park, and $1,150,216.00 for Dr. Martin Luther King, Jr. Boulevard and 7th Avenue/Crane Street from the New Jersey Department of Transportation are hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
    1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award in the amount of $1,595,061.00 for Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park, and $1,150,216.00 for Dr. Martin Luther King, Jr. Boulevard and 7th Avenue/Crane Street.
    1. Upon notification of final authorization of this project, the Director of the Department of Engineering shall submit a complete copy of the grant/project agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.
    1. No municipal funds are required for receipt or acceptance of this grant award.
    1. The Director of Engineering shall file a fully-executed copy of the grant award letter, the final authorization letter, and the grant/project agreement in the Office of the City Clerk.
 
 
STATEMENT
 
This resolution ratifies and authorizes the City of Newark, Department of Engineering to accept grant funding, and furthermore, ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute an agreement with and accept grant funds in the amount of $1,595,061.00 for Broad Street and South Street, Broad Street and Tichenor Street/Lincoln Park, and $1,150,216.00 for Dr. Martin Luther King, Jr. Boulevard and 7th Avenue/Crane Street. No municipal funds are required for receipt or acceptance of this grant award.
