WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") through the Local Aid Infrastructure Fund ("LAIF") provides grant funding for the construction of new bikeways; and

WHEREAS, the City of Newark (the "City") desires to obtain funding from the 2025 LAIF to construct a bikeway on Mulberry Street form Center Street to Edison Place; and

WHEREAS, the Acting Director of the Department of Engineering submitted an electronic grant application on or about June 24, 2025 to NJDOT, on behalf of the City of Newark, requesting grant funding in the amount of One Million Seven Hundred Seventy Eight Thousand Three Hundred Twenty Three Dollars and Zero Cents ($1,778,323.00), from the New Jersey Department of Transportation's 2025 LAIF, to construct a new bikeway along Mulberry Street, with no City funds required; and

WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City is required to submit a resolution from the Municipal Council authorizing submission of the grant application; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Acting Director of the Department of Engineering desires to accept the grant award and execute a grant agreement governing said award; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Acting Director of the Department of Engineering, shall submit a copy of the grant agreement to the Office of the City Clerk, the Corporation Counsel and the Business Administrator for review, approval, and signature.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to submit an electronic grant application to the New Jersey Department of Transportation on behalf of the City of Newark, requesting grant funding in the amount of One Million Seven Hundred Seventy Eight Thousand Three Hundred Twenty Three Dollars and Zero Cents ($1,778,323.00), from the New Jersey Department of Transportation's 2025 LAIF, to construct a new bikeway along Mulberry Street from Center Street to Edison Place, with no City funds required (a copy of the application is attached hereto and made a part hereof).

2. The Municipal Council of the City of Newark recognizes and accepts that the Department may offer a lesser or greater amount and therefore, upon receipt of the grant agreement from the New Jersey Department of Transportation, does further authorize the execution of any such grant agreement upon review, approval and signature by the City's Mayor and Corporation Counsel; and also, upon receipt of the fully executed agreement from the Department, does further authorize the acceptance of the grant funds and the expenditure of the funds pursuant to the terms of the agreement between the City of Newark and the New Jersey Department of Transportation.

3. Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award from the LAIF to construct a new bikeway along Mulberry Street from Center Street to Edison Place.

4. Upon notification of the receipt of a grant award in connection with this application, the Acting Director of the Department of Engineering shall submit a complete copy of the grant agreement and any associated documents to the Office of the City Clerk, the Corporation Counsel and the Business Administrator for review, approval, and signature.

5. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing Resolution.

6. No municipal funds are required for receipt or acceptance of this grant award.

7. The Acting Director of the Department of Engineering shall file a fully-executed copy of the grant application, grant award letter, and grant agreement in the Office of the City Clerk.

This Resolution ratifies and authorizes the Mayor and/or his designee, the Acting Director of the Department of Engineering, to submit an electronic grant application, to accept and enter into an agreement for grant funding from the New Jersey Department of Transportation's 2025 Local Aid Infrastructure Fund in the amount of One Million Seven Hundred Seventy Eight Thousand Three Hundred Twenty Three Dollars and Zero Cents ($1,778,323.00), to construct a new bikeway along Mulberry Street from Center Street to Edison Place. No municipal funds are required for receipt or acceptance of this grant award
