WHEREAS, on June 9 2015, the City of Newark through its Director of Purchasing advertised to solicit bids for contractors to provide, a 2015 Wood Chipper, Brush and Tree, to the Department of Neighborhood and Recreational Services through the Division of Motors as per the proposal attached hereto; and
WHEREAS, the Division of Central Purchasing distributed eight (8) bid proposal packages to prospective vendors following the date of advertisement; and
WHEREAS on June 25, 2015 three (3) bids were received in response to this advertisement; and
WHEREAS, the Manager of Motors reviewed the bids and recommended that an award be made to the lowest responsive responsible bidder, North Eastern Arborists Supply; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meets the requirements of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/ or his designee, the Purchasing Director, are hereby authorized to enter into a contract with North Eastern Arborist Supply, 50 Notch Road, Woodland Park, New Jersey 07424, to provide a 2015 Wood Chipper, Brush and Tree, to the City of Newark, whose bid was received on the advertised due date and determined to be the lowest responsive bidder in accordance with bid specifications. The term on the contract will be upon complete delivery no later than December 31, 2015.
2. There shall be no amendment or change of this contract without the approval of the Newark Municipal Council.
3. Funds for this acquisition is encumbered on PO# 26723, Fund NW051, Account # 94340, Budget Year 2014. This contract shall not exceed $52,050.00.
4. Pursuant to N.J.S.A. 27:25-17, any and all debts, expenses or obligations incurred by the City Department shall be payable only from funds available to the City of Newark, and no liability or obligation shall be incurred by the City Department beyond the extent to which monies are available.
5. It is the responsibility of the Director of Neighborhood and Recreational Services, and the Division of Motors to ascertain the 2015 Wood Chipper, Brush and Tree, as offered by the vendor, is in compliance with the specifications and will provide the Municipal Council, the Business Administrator and the Director of Purchasing with appropriate reports during the term of the contract.
6. A duly executed copy of the contract shall be forthwith filed in the Office of the City Clerk by the Director of Purchasing.
7. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract, to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
