WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $1,400,000.00 for the Childhood Lead Exposure Prevention (CLEP) Program and no adequate provision has been made in the 2021 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, by award letter dated December 18, 2020, the State of New Jersey Department of Health has awarded funds to the City of Newark for the Childhood Lead Exposure Prevention (CLEP) Program. The aforementioned funds are set aside to provide lead exposure prevention, community outreach, case management, environmental interventions and lead abatement services for children with EBL’s (Elevated Blood Level’s) of five (5) and above; and
WHEREAS, a previous Temporary Emergency Appropriation TE #1 submitted to the Municipal Council for approval totaled $898,683.00; and
WHEREAS, N.J.S.A. 40A: 4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriations adopted in 2021, pursuant to N.J.S.A. 40A: 4-20 including this resolution total…………………$2,298,683.00.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:
1. The Governing Body by a two-thirds vote of its full membership hereby amends its temporary budget by making the follow emergency temporary appropriations.
2. A temporary emergency appropriation be and the same is hereby
made for the following classification:

3. Said emergency appropriation shall be provided for in the 2021 budget.
4. A copy of this resolution shall be filed with the Director of Local Government Services by the City Clerk.
STATEMENT
This resolution authorizes and establishes the Temporary Emergency Appropriation for the Childhood Lead Exposure Prevention (CLEP) Program in the amount of $1,400,000.00. The State of New Jersey Department of Health has awarded the funds to the City of Newark. The project period is October 1, 2020 through June 30, 2021.
