WHEREAS, the Department of Engineering, City of Newark, is in need of Asbestos Monitoring Service and Structural Components Testing for the Renovation of the Chestnut Street Firehouse, located at 87-89 Elm Road, Newark, NJ 07105; and
WHEREAS, on February 2, 2012, the Department of Engineering advertised Specifications for Labor and Materials for Asbestos Monitoring Service and Structural Components Testing for Renovation of the Chestnut Street Firehouse, 87-89 Elm Road, Newark, NJ 07105, for the receipt of bids from qualified licensed vendors to provide those services; and
WHEREAS, six (6) bids were solicited by the Department of Engineering to firms; and
WHEREAS, on March 8, 2012 one (1) bid was received from Birdsall Services Group, Inc., 65 Jackson Drive, Cranford, NJ 07016; and
WHEREAS, after a review of the proposal dated March 8, 2012, the Director of the Department of Engineering has determined that Birdsall Services Group, Inc., 65 Jackson Drive, Cranford, NJ 07016, which submitted a bid proposal for the total amount of $100,725.00, plus an allowance of $10,000.00 (which may not be expended), is the lowest responsible bidder; and
WHEREAS, a public bid pursuant to the requirements of the Local Public Contracts Law is a fair and open process in accordance with the State Pay-to-Play Law (N.J.S.A. 19:44A-20.5).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee and the Director of the Department of Engineering is hereby authorized on behalf of the City of Newark to execute a professional services Contract #03-2012 Asbestos Monitoring Services and Structural Components Testing for the Renovation of the Chestnut Street Firehouse, located at 87-89 Elm Road, Newark, NJ 07105, to Birdsall Services Group, Inc., 65 Jackson Drive, Cranford, NJ 07016, for the base bid amount of $100,725.00, plus an allowance of $10,000.00 (which may be expended), for a total amount of $110,725.00
2. Attached hereto is a certification of funds issued by the Chief Financial Officer, City of Newark, which states that there are available sufficient legally appropriated funds in the amount of $110,725.00, for the purposes set forth herein. A copy of the certification of funds shall be filed in the Office of City Clerk by the Director of Engineering, together with this resolution.
3. The term of this contract shall be one (1) year from the date a formal "Notice to Proceed" is issued by the Director of Engineering or his designee.
4. No changes to this contract shall be allowed or authorized without prior Municipal Council approval.
5. There shall be no advance payments made against this contract in accordance with N.J.A.C. 40A:5-16.
6. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of Engineering or his designee.
7. Birdsall Services Group, Inc., 65 Jackson Drive, Cranford, NJ 07016, has certified that it has neither made nor will make a prohibited contribution in violation of any applicable federal or state laws, or City Ordinances, including but not limited to the Executive Order on Pay-to-Play Reform (MEO-7-0001) as may be amended from time to time. Any such failure shall constitute a breach of the Contract.
8. Funds for this contract in the amount of $110,725.00, is provided from Fund:045, Department:007, Project:07BO0, Account:94710, Budget Year:B2007
STATEMENT
This resolution authorizes the Mayor and/or his designee and the Director of the Department of Engineering to execute Contract #03-2012 Asbestos Monitoring Service and Structural Components Testing at the Chestnut Street Firehouse, located at 87-89 Elm Road, Newark, NJ 07105, to Birdsall Services Group, Inc., 65 Jackson Drive, Cranford, NJ 07016, the lowest, responsible bidder for the base bid amount of $100,725.00, plus an allowance of $10,000.00 (which may not be expended), for a total amount of $110,725.00 for a period of one (1) year from the issuance of a formal written Notice to Proceed.
