 WHEREAS, the City of Newark engaged contractors to provide temporary staffing for Professional Personnel Services, including but not limited to healthcare, mental and social services. The professional personnel temporary staff serviced the City of Newark, primarily at four (4) locations: 920 Broad Street, Newark, New Jersey 07102, 110 William Street, Newark, New Jersey, 94 William Street, Newark, New Jersey and 394 University Avenue, Newark, New Jersey; and

 

WHEREAS, the City of Newark Department of Child and Family Well-Being entered into a contract with Axion Healthcare Solutions, LLC, n/k/a Axion Worldwide LLC and Delta-T Group North Jersey, Inc., pursuant to Resolution 7R2-a adopted February 6, 2013, for the provision of temporary staffing for professional personnel services, including but not limited to healthcare, mental and social services, for the period of one (1) year from the date of adoption with an option to renew for one (1) additional year; and

 

                     WHEREAS, the contract is an open-ended contract not to exceed two million dollars and no cents ($2,000,000.00); and

 

WHEREAS, the City of Newark desires to exercise the option to renew the contract with Axion Worldwide LLC, formerly known as Axion Healthcare Solutions, LLC  and Delta-T Group North Jersey, Inc., for the period of March 4, 2014 through March 3, 2015, in the amount not to exceed two million dollars and no cents ($2,000,000.00); and

 

WHEREAS, this contract was awarded pursuant to the Fair and Open Process, as defined at N.J.S.A.19:44A-20.7, and is therefore in compliance with “New Jersey Local Unit Pay-to-Play” law.

                     

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Child and Family Well-Being is hereby authorized to exercise its option to renew and execute a contract with Axion Worldwide LLC, formerly known as Axion Healthcare Solutions LLC, 510 Thornall Street, Suite 110, Edison, NJ 08837 and Delta-T Group North Jersey, Inc., One Woodbridge Center, Suite 512, Woodbridge, New Jersey 07095, for the contract period of March 4, 2014 through March 3, 2015, in an amount not to exceed two million dollars and no cents ($2,000,000.00), for the provision of temporary staffing for professional personnel services.

 

2.                     The Municipal Council hereby ratifies this contract amendment and renewal for an additional year from March 4, 2014 to the date of adoption of this authorizing resolution.

 

3.                     The contract and the amendment to renew for an additional year is awarded pursuant to the Fair and Open Process  of N.J.S.A.19:44A-20.5, and as competitive bidding contract pursuant to Local Public Contracts Law N.J.S.A. 40A:11-5(1), which provides that a contract of this type itself must be available for public inspections.

 

4.                     The contract and amendment to renew for an additional year is further awarded as an open-ended contract pursuant to N.J.A.C.  5:30-5.5(b) (2). A Certification of Funds shall be executed each time services are used and charged against this contract.

 

5.                     Pursuant to N.J.S.A. 27:25-17, any and all debts, expenses or obligations incurred by the Department of Child and Family Well-Being shall be payable only from funds available to the City of Newark, and no liability or obligation shall be incurred by the Department of Child and Family Well-Being beyond the extent to which monies are available.

 

6.                     A notice of this action shall be printed in a local newspaper as required by law within ten (10) days hereof.

 

7.                     A copy of the contract amendment to renew for an additional year is attached hereto.

 

8.                     A copy of the executed Contract amendment shall be filed forthwith in the Office of the City Clerk by the Director of the Department of Child and Family Well-Being.

 

 

STATEMENT:

 

This Resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Child and Family Well-Being, to exercise its option to renew and execute an open-ended contract amendment with Axion Worldwide LLC, formerly known as Axion Healthcare Solutions, LLC, 510 Thornall Street, Suite 110 Edison, New Jersey 08837 and Delta-T Group North Jersey, Inc., One Woodbridge Center, Suite 512, Woodbridge, New Jersey 07095, for the provision of Temporary Staffing for Professional Personnel Services in the City of Newark, for the period of March 4, 2014 through March 3, 2015, in the amount not exceed two million dollars and no cents ($2,000,000.00).
