WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of 579,790.00 for the Public Health Infrastructure, Laboratories and Emergency Preparedness (PHILEP)/Bio-Terrorism Program (hereinafter the “Bio-Terrorism Program”) and no adequate provision has been made in the 2021 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, by grant agreement dated October 21, 2020, the State of New Jersey Department of Health has awarded the City of Newark funds for the Bio-Terrorism Program in the amount of Five Hundred Seventy-Nine Thousand Seven Hundred Ninety Dollars and Zero Cents ($579,790.00) to upgrade the City of Newark’s public health preparedness and response capabilities.; and
WHEREAS, a previous resolution authorizing TE #4 and prior emergency appropriations submitted for Municipal Council approval totaled $2,729,633.00; and
WHEREAS, N.J.S.A. 40A: 4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriation adopted in 2021, pursuant to N.J.S.A. 40A: 4-20 including this resolution total…………………$3,309,423.00.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Governing Body by a two-thirds vote of its full membership hereby amends its temporary budget by making the following temporary emergency appropriation:

4. A copy of this resolution shall be filed with the Director of Local Government Services by the City Clerk of the City of Newark.
STATEMENT
This resolution authorizes and establishes the temporary emergency appropriation for the Public Health Infrastructure, Laboratories and Emergency Preparedness (PHILEP)/Bio-Terrorism Program in the amount of $579,790.00. The State of New Jersey Department of Health has awarded the funds. The project period is July 1, 2020 through June 30, 2021 (City-wide).
