AN ORDINANCE AMENDING TITLE 41, ZONING AND LAND USE REGULATIONS, CHAPTER 10, HISTORIC SITES AND DISTRICTS, SUBSECTIONS 10-4-1, NOMINATION, 10-4-2, APPLICATION FEE, 10-4-3 INITIAL REVIEW, AND 10-4-4 AUTOMATIC DESIGNATION,  OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, TO STREAMLINE THE LOCAL HISTORIC DESIGNATION PROCESS BY REPLACING THE NATIONAL REGISTER OF HISTORIC PLACES REGISTRATION FORM REQUIREMENT WITH A CITY-SPECIFIC APPLICATION FORM, ESTABLISHING A NOMINAL APPLICATION FEE, AND AUTHORIZING THE DIVISION OF PLANNING AND ZONING TO RETAIN TECHNICAL EXPERTISE AS NEEDED.

WHEREAS, the Central Planning Board of the City of Newark (“Planning Board”) adopted the Newark360 Master Plan and Land Use Element (“Newark360”) at a duly noticed public hearing on September 26, 2022; and

WHEREAS, on November 1, 2023, the Newark Municipal Council (“Municipal Council”) adopted Ordinance 6PSF-e, a wholesale amendment to Title 41 of the Municipal Code of the City of Newark (Zoning and Land Use Regulations), to replace the former ordinance as a continuation of the Newark360 process and designed to effectuate the policy statements and recommendations contained therein; and

WHEREAS, on April 15, 2026, the Municipal Council adopted Resolution 7R2-l, referring an amendment, attached hereto as Exhibit A, to Title 41 of the Municipal Code of the City of Newark (Zoning and Land Use Regulations), Chapter 10: Historic Sites and Districts, to streamline the local historic designation process by replacing the National Register of Historic Places Registration Form requirement with a city-specific application form, attached hereto as Exhibit B, establishing a nominal application fee, and authorizing the Division of Planning and Zoning to retain technical expertise as needed (“Proposed Amendment”), to the Newark Central Planning Board for review and recommendation in accordance with N.J.S.A. 40:55D-64; and

WHEREAS, after a public hearing on May 11, 2026, the Newark Central Planning Board, adopted a Memorialization Resolution, recommending that the Newark Municipal Council adopt the Proposed Amendment as it is substantially consistent with the Newark360 Master Plan and Land Use Element.

NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

Section 1: Title 41 of the Municipal Code of the City of Newark entitled “Zoning and Land Use Regulations”, Chapter 10, Historic Sites and Districts, is hereby amended in the form attached hereto as shown in Exhibit A and B and made a part of this Ordinance, is hereby adopted in accordance with the recommendations of the Newark Central Planning Board pursuant to its Memorialization Resolution of May 11, 2026.

Section 2:  This Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.

Section 3:  To the extent that any previous ordinance is inconsistent with or contradictory hereto, said ordinance is hereby amended to the extent necessary to make it consistent herewith.

Section 4:  The provisions of this Ordinance are severable. To the extent any clause, phrase, sentence, paragraph or provision of this Ordinance shall be declared invalid, illegal, or unconstitutional, the remaining provisions shall continue in full force and effect.

Section 5.  Codification. This Ordinance shall be a part of the Code of the City of Newark as though codified and fully set forth therein. The City Clerk shall have this Ordinance codified and incorporated in the official copies of the Code. The City Clerk and the Corporation Counsel are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Newark in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed.

 

STATEMENT

This Ordinance amends the Newark Zoning and Land Use Regulations by amending Chapter 10: Historic Sites and Districts, to streamline the local historic designation process by replacing the National Register of Historic Places Registration Form requirement with a city-specific application form, establishing a nominal application fee, and authorizing the Division of Planning and Zoning to retain technical expertise as needed.
