WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (the “State”), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and
WHEREAS, on or about February 15, 2017, on behalf of the City of Newark (the “City”), the Executive Vice President of Real Estate Development of the Newark Community Economic Development Corporation (“NCEDC”), the then designee of the Mayor of the City of Newark, submitted an application to the New Jersey Department of Environmental Protection, Green Acres Program in solicitation of Green Acres grant funding (the “Application”) for the acquisition of various properties, for the expansion of the Newark Riverfront Park Project (“Project”); and
WHEREAS, the City desires to further the public interest by obtaining a Green Acres grant in the amount of One Million Dollars and Zero Cents ($1,000,000.00) from the State to fund the following project(s): #0714-17-052 Newark Riverfront Park Acquisition Project for the expansion of the Project; and
WHEREAS, as a result of the Application, the City has been awarded a grant in the amount of One Million Dollars and Zero Cents ($1,000,000.00) (the “Grant Award”) from the State for the Project; and
WHEREAS, the Grant Award requires a Seventy Five Percent (75%) match and therefore the City is required to contribute approximately Three Hundred Thirty-Three Thousand Three Hundred Thirty-Three Dollars and Zero Cents ($333,333.00); and
WHEREAS, the City, also known as Applicant is willing to use the State’s funds, also known as Grant Award, in accordance with such rules, regulations and applicable statutes, and is willing to enter into the Green Acres Project Agreement with the State for the receipt of the Grant Award for the above named Project (the “Grant Agreement”); and
WHEREAS, the City requests authorization to submit the Application and execute the Grant Agreement with the State for the Project.
NOW, THEREFORE BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee and the Deputy Mayor/Director of the Department of Economic and Housing Development are hereby authorized, on behalf of the City of Newark, to submit an application to the New Jersey Department of Environmental Protection, Green Acres Program, requesting grant funding, for the acquisition of various properties for the Newark Riverfront Park Acquisition Project, provide additional application information, and furnish such documents as may be required by the State. The approval of the Application, which is attached hereto and made a part hereof, results in a seventy-five percent (75%) match from the State, and thus requires a contribution from the City of Newark.
2. The Municipal Council ratifies its authorization of this Application from the date of Application submission to the date of adoption of this authorizing Resolution.
3. The grant award from the State in the amount of One Million Dollars and Zero Cents ($1,000,000.00)(“Grant Award”), requiring a City contribution in the amount of Three Hundred Thirty-Three Thousand Three Hundred Thirty-Three Dollars and Zero Cents ($333,333.00) is hereby accepted.
4. The Mayor of the City of Newark and/or his designee and the Deputy Mayor/Director of the Department of Economic and Housing Development are hereby authorized to execute the Green Acres Project Grant Agreement with the State and any amendment thereto for receipt of the Grant Award for the Project known as Newark Riverfront Park Acquisition Project.
5. The City also known as Applicant has its matching share of the project, in the amount of Three Hundred Thirty-Three Thousand Three Hundred Thirty-Three Dollars and Zero Cents ($333,333.00). Attached hereto is a Certification of Funds in the amount of Three Hundred Thirty-Three Thousand Three Hundred Thirty-Three Dollars and Zero Cents ($333,333.00) from Account Line: NW045-16G-16C00-A-94710-B2016.
6. In the event the State’s funds are less than the total project cost specified above, the Applicant has the balance of funding necessary to complete the Project.
7. The City, also known as Applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the Project.
8. The Deputy Mayor/Director of the Department of Economic and Housing Development shall file the Application, Certification of Funds, and fully executed Grant Agreement along with this Resolution in the Office of the City Clerk.
9. This Resolution shall take effect immediately.
STATEMENT
This Resolution ratifies and authorizes the actions taken by the Mayor of the City of Newark and/or his designee and the Deputy Mayor/Director of the Department of Economic and Housing Development to submit an application for grant funding from the New Jersey Department of Environmental Protection, Green Acres Program and further authorizes the Mayor of the City of Newark and/or his designee and the Deputy Mayor/Director of the Department of Economic and Housing Development to accept grant funds from the State, by entering into and executing the Green Acres Project Agreement in connection therewith, in the form attached hereto as Exhibit A.
