WHEREAS, the United States Department of Justice ("USDOJ"), Office of Juvenile Justice and Delinquency Prevention ("OJJDP") solicited proposals for the Community-Based Violence Prevention Demonstration Program (the "Grant"), which encourage cities to develop community-based strategies to reduce crime, violence and recidivism; and
 
WHEREAS, in May 2011, the Newark Police Department, in partnership with the Department of Economic and Housing Development's Office of Reentry, submitted an application (the "Application") to the USDOJ for Grant, requesting grant funding in the amount of $2,196,085.00; and
 
WHEREAS, the Application proposed a historic opportunity to fund a comprehensive violence prevention program using proven, evidence-based strategies that would, among other things: fund the hiring of approximately four police officers to conduct community policing in specific crime grids where much of the violent activity in Newark occurs; fund community mentoring, case management, job development, and transitional jobs for 125 of the "highest risk" 16 to 30 year-olds who are likely to perpetrate or be victims of shootings and murders; fund and support community mobilization and outreach by Newark residents; fund program oversight of grant operations; and
 
WHEREAS, through programs such as Boston Ceasefire, these efforts have been proven methods of long-term and significant reductions in crime, can create economic opportunity and contribute to long-term community stability; and
 
WHEREAS, as a result of this Application, on August 31, 2011, the City of Newark was awarded a grant in the amount of $2,196,085.00 from the USDOJ to develop community-based strategies to reduce crime, violence and recidivism for a grant period commencing on October 1, 2011 and terminating on September 30, 2014; and
 
WHEREAS, the City must execute a cooperative agreement with USDOJ with municipal funds required; and
 
WHEREAS, any and all additional and/or remaining expenses under the terms of the grant award and cooperative agreement approximated at $150,333.00 annually in Budget Years 2012, 2013, and 2014, shall be borne by the City of Newark through the municipal budget.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.        The Mayor and/or his designee, the Deputy Mayor/Director of Economic and Housing Development and/or the Police Director, are hereby authorized to submit an application to the United States Department of Justice requesting grant funding in the amount of $2,196,085.00 for developing community-based strategies to reduce crime, violence and recidivism with $450,999.00 City funds required.
 
2.        This grant authorizes the hiring of four(4) police officers; it is solely under the authority, direction and discretion of the Director of the Newark Police Department that such hires may be made pursuant to this grant.  All other civilian actions anticipated such as hiring of consultant management and employment contractors by this grant may be guided by the Deputy Mayor/Director of Economic and Housing Development.  
 
3.        The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
 
4.        The grant award in the amount of $2,196,085.00 from the United States Department of Justice is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
 
5.        The Mayor and/or his designee, the Deputy Mayor/Director of Economic and Housing Development, are hereby authorized to enter into and execute grant documents with the United States Department of Justice to receive and expend the grant award in the amount of $2,196,085.00 for developing community-based strategies to reduce crime, violence and recidivism for the grant period commencing on October 1, 2011 and terminating on September 30, 2014 (a copy of the Agreement is attached hereto and made a part hereof).
 
6.        The City shall be responsible through its municipal budget to pay approximately $150,333.00 annually in budget years 2012, 2013, and 2014 for police officer health, dental, prescription benefits, stress differentials, and pension for an approximate total of $450,999.00.
 
7.        Funds to cover the costs of the police officer health, dental, prescription benefits, stress differentials and pension shall be provided for from the Police Budget:  Account: Unclassified Personnel Services - 60210-60200; Budget Ref.-B2011; Div. - 2011; Department - 200; Current Fund Code - 011.  
 
8.        The cooperative agreement is contingent upon appropriation pursuant to N.J.A.C. 5:30-5.5(d)(2) for budget years 2012, 2013 and 2014, to cover police officer health, dental, and prescription benefits, stress differentials, and pension.  
 
9.        The agreement between the City of Newark and the United States Department of Justice, Office of Juvenile Justice and Delinquency is hereby ratified from October 1, 2011 to the date of adoption of this authorizing resolution.
 
10.        The Deputy Mayor/Director of Economic and Housing Development shall file a fully-executed copy of the grant application, the grant award letter, the cooperative agreement, and a copy of the Certification of Funds for any required municipal funds in the Office of City Clerk.      
 
STATEMENT
 
This resolution ratifies and authorizes the actions taken by the Deputy Mayor/Director of Economic and Housing Development and the Director of the Newark Police Department to submit an application for grant funding from the United States Department of Justice for developing community-based strategies to reduce crime, violence and recidivism, and furthermore, ratifies and authorizes the Mayor and/or his designee(s), the Deputy Mayor/Director of Economic and Housing Development and/or the Director of the Newark Police Department, to enter into and execute an agreement with and accept grant funds in the amount of $2,196,085.00 from the United States Department of Justice for developing community-based strategies to reduce crime, violence and recidivism for the grant period commencing on October 1, 2011 and terminating on September 30, 2014. Municipal funds are required to cover the cost of police officer health, dental, and prescription benefits, stress differentials, and pension in the approximate amount of $150,333.00 annually for Budget Years 2012, 2013, and 2014,($450,999.00) for a total grant program budget of $2,647,084.00.
