WHEREAS, the State of New Jersey Board of Public Utilities (NJBPU) created a 2023 Clean Fleet Electric Vehicles Incentive Program for Municipalities in New Jersey to support the purchase of eligible Battery Electric Vehicles ("BEV"), Level-Two Electric Vehicle ("EV") Charging equipment, and Direct Current Fast Chargers ("DCFCs") for fleet charging; and

WHEREAS, the 2023 Clean Fleet Electrical Vehicle Incentive Program, primary goal of this grant is to improve New Jersey's air quality for a better environment for all residents and to assist Local and State Government entities in transitioning to electrically-powered fleets; and

WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the NJBPU for the City of Newark transition to electrically powered fleet in order to improve New Jersey air quality for current and future generations; and

WHEREAS, on May 31, 2023, on behalf of the City of Newark, the Director of the Department of Water and Sewer Utilities submitted an application to the New Jersey Board of Public Utilities requesting grant funding for five (5) vehicles, a "networked" charger capable of collecting data, three (3) DCFC Charging Stations; and

WHEREAS, as a result of this application, the City of Newark has been awarded grant in the amount of Sixty Hundred Thirty Thousand Zero Dollars and Zero Cents ($630,000.00) from the 2023 Clean Fleet Electric Vehicles Incentive Program for Vehicle, Network Charging capable of collecting data and Charging Station for the period of May 1, 2024 through May 1, 2026; and

WHEREAS, the City must execute a grant agreement with The New Jersey Board of Public Utilities (NJBPU) in order to obtain the grant award with no matching funds required.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, are hereby authorized to submit an application to New Jersey Board of Public Utilities (NJBPU) requesting Clean Fleet Program grant funding in the amount of Sixty Hundred Thirty Thousand Zero Dollars and Zero Cents ($630,000.00) from the Clean Fleet program grant for the transitioning to electrically-Powered fleets with no City funds required (a copy of the application is attached hereto and made a part hereof).

2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.

3. The grant award in the amount of $630,000.00 from New Jersey Board of Public Utilities (NJBPU) is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).

4. The Mayor and/or his designee, the Director of the Department of Water and Sewer utilities, are hereby authorized to enter into and execute grant documents with New Jersey Board of Public Utilities (NJBPU) to receive and expend the grant award in the amount of $630,000.00 for transitioning to electrically-Powered fleets for the period commencing on May 1, 2024 and terminating on May 1, 2026 (a copy of the Agreement is attached hereto and made a part hereof).

5. No Municipal fund are required for receipt of acceptance of the grant award.

6. The Director of the Department of Water and Sewer Utilities shall file a fully-executed copy of the New Jersey Public Utilities Clean Fleet Program application, the grant award letter, the grant agreement, and a copy of the Certification of Funds for any required matching funds in the Office of City Clerk.

STATEMENT

This resolution ratifies and authorizes the actions taken by the Director of the Department of Water and Sewer Utilities to submit an application for grant funding from New Jersey Board of Public Utilities (NJBPU) for the Clean Fleet Program for transitioning to Electrically-Powered fleets, and furthermore, authorizes Mayor and/or his designee, the Director of Department of Water and Sewer utilities, to enter into and execute an agreement with and accept grant funds in the amount of $630,000.00 from New Jersey Board of Public Utilities (NJBPU) for the Clean Fleet Program for transitioning to electrically-Powered fleets for the period commencing on May 1, 2024 and terminating on May 1, 2026. No municipal funds are required.
