Resolution 7R1-b, adopted on January 7, 2009 accepted a matching grant award from the Green Acres Program in the amount of $500,000.00.
Resolution 7R9-a, adopted on August 3, 2016 accepted an additional matching grant award from the Green Acres Program in the amount of $850,000.00.
This amending resolution will increase the grant funding in the amount of $1,300,000.00 ($550,000.00 from the State’s Green Acres Program and $750,000.00 from the National Park Service’s Land and Water Conservation Fund, managed by the State’s Green Acres Program).

WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (the “State”), provides loans and/or grants to municipal and county governments and grants to non-profit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and
WHEREAS, the City of Newark (the “City”) previously obtained matching grant funding from the State in the amount of One Million Three Hundred Fifty Thousand Dollars and Zero Cents ($1,350,000.00) as set forth in greater detail below to fund Project - #0714-07-042 Jesse Allen Park located at 41-55 Avon Avenue, Block 2583, Lot 44, Newark, New Jersey 07108 (the “Jesse Allen Park Project”); and
WHEREAS, pursuant to Resolution 7R1-b, adopted on January 7, 2009, the City accepted a matching grant award from the Green Acres Program in the amount of Five Hundred Thousand Dollars and Zero Cents ($500,000.00) and authorized the Mayor and/or his designee, the Business Administrator, to enter into and execute a grant agreement with the New Jersey Department of Environmental Protection for the development of Jesse Allen Park Project; and
WHEREAS, pursuant to Resolution 7R9-a, adopted on August 3, 2016, the City accepted an additional Eight Hundred Fifty Thousand Dollars and Zero Cents ($850,000.00) in grant funding from the Green Acres Program for the development of Jesse Allen Park Project and authorized the Mayor and/or his designee to enter into and execute an amended grant agreement with the New Jersey Department of Environmental Protection, bringing the total amount of the Grant to One Million Three Hundred Fifty Thousand Dollars and Zero Cents ($1,350,000.00); and
WHEREAS, the City’s Director of the Department of Recreation, Cultural Affairs and Senior Services submitted an application to the State for financial assistance to be used towards the Jesse Allen Park Project and the State has found it to be in conformity with the scope and intent of the Green Acres Program and has approved the City’s request and has awarded the City matching grant funding in the amount of Five Hundred Fifty Thousand Dollars and Zero Cents ($550,000.00) to be used towards the Jesse Allen Park Project; and
WHEREAS, the State has received a certain Outdoor Recreation Legacy Partnership Program grant from the National Park Service’s Land and Water Conservation Fund and the State has agreed with any application from the City to pass through Seven Hundred Fifty Thousand Dollars and Zero Cents ($750,000.00) to the City to be used towards the Jesse Allen Park Project; and
WHEREAS, the City agrees to use the State’s funds in accordance with the Outdoor Recreation Legacy Partnership Program terms and conditions, as well as the State’s rules, regulations and applicable statues, and is willing to enter into an Amendment of the Agreement with the State for the Project - #0714-07-042, Jesse Allen Park; and
WHEREAS, the City must execute an Amended Green Acres Project Agreement in order to obtain the above-referenced grant funding totaling $1,300,000.00.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services are hereby authorized to submit an application to the New Jersey Department of Environmental Protection, Green Acres Program requesting additional grant funding to fund Project - #0714-07-042 Jesse Allen Park located at 41-55 Avon Avenue, Block 2583, lot 44, Newark, New Jersey 07108 (the “Jesse Allen Park Project”).
2. The Municipal Council ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
3. The grant award in the amount of Five Hundred Fifty Thousand Dollars and Zero Cents ($550,000.00) from the State’s Green Acres Program is hereby accepted.
4. The grant award in the amount of Seven Hundred Fifty Thousand Dollars and Zero Cents ($750,000.00) from the National Park Service’s Land and Water Conservation Fund, managed by the State’s Green Acres Program is hereby accepted.
5. The Municipal Council amends Resolution 7R9-a, adopted on August 3, 2016, and authorizes the Mayor and/or his designee, the Business Administrator and/or the Director of the Department of Recreation, Cultural Affairs and Senior Services, to enter into and execute an Amended Green Acres Project Agreement, in the form attached hereto, which shall supersede the Green Acres Project Agreement dated March 9, 2009 and all subsequent Agreements and Amendment through November 16, 2016, to be used towards the Jesse Allen Park Project for the grant period terminating two (2) years from the date the Amended Green Acres Project Agreement is executed by the State (a copy of the Amended Green Acres Project Agreement is attached hereto and made a part hereof).
6. The City has already satisfied its matching share of the project in the amount of $1,150,000.00.
7. In the event the State’s funds are less than the total project cost specified above, the applicant has the balance of funding necessary to complete the project.
8. The applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project.
9. The Director of the Department of the Department of Recreation, Cultural Affairs and Senior Services shall file a fully-executed copy of the grant application to the State, the grant award letter, and the Amended Green Acres Project Agreement in the Office of City Clerk.
STATEMENT
This resolution ratifies and authorizes the actions taken by the Director of the Department of Recreation, Cultural Affairs and Senior Services to submit an application for grant funding from the New Jersey Department of Environmental Protection, Green Acres Program to fund Project - #0714-07-042 Jesse Allen Park located at 41-55 Avon Avenue, Block 2583, Lot 44, Newark, New Jersey 07108 (the “Jesse Allen Park Project”), and further ratifies and authorizes the Mayor and/or the Director of the Department of Recreation, Cultural Affairs and Senior Services to enter into and execute an Amended Green Acres Project Agreement with and accept grant funds in the amount of $1,300,000.00 ($550,000.00 from the State’s Green Acres Program and $750,000.00 from the National Park Service’s Land and Water Conservation Fund, managed by the State’s Green Acres Program) to be used towards the Jesse Allen Park Project for the grant period terminating two (2) years from the date the Amended Green Acres Project Agreement is executed by the State.
