AN ORDINANCE AMENDING VARIOUS TITLES OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, ADJUSTING THE LICENSE RENEWAL PERIOD AND FEE TO MATCH THE NEW BIENNIAL LICENSING SCHEDULE FOR CERTAIN ESTABLISHMENTS, THROUGHOUT THE CITY OF NEWARK.

WHEREAS, the City of Newark desires to have uniformed business licensing fees and periods of renewal; and

 

WHEREAS, establishing biennial periods of renewal and altering fee schedules will reduce the hardship of business owners in having to renew their licenses annually; and

 

WHEREAS, in order to facilitate the City of Newark’s consolidated business licensing process, the Department of Finance had to create a new Section under Title VIII of the revised ordinances, titled Title VIII, Business and Occupations, Chapter 8, Section 36 entitled “Consolidated Business Licenses”; and

 

WHEREAS, all effected ordinances must be revised to reflect with the changes to the renewal period and fees. 

 

           NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

SECTION 1.                      Title V, Amusement and Amusement Business, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, is revised and creates the following:

 

5:1. Arcades

 

5:1-5. License Fee

 

The fee to be paid for the license required by this Chapter shall be $1,500 per annum $3,000 biennially. The license shall expire biennially on March 31st after its date of issuance. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on March 31st in accordance with the biennial licensing cycle.

 

5:2. Coin-Operated Amusement Devices 

 

5:2-6. License Fee; Term of License

 

a.                      The license fees for each coin-operated amusement device shall be $75 $150.00 payable biennially upon presentation of the application and shall be returned less the sum of $15 $30 in the event the license is not granted.

 

b.                      All licenses issued, and renewals thereof, under this Chapter shall expire biennially on March 31st after its date of issuance. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on March 31st in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a coin-operated amusement device license.

 

5:2-18. Prerequisites to Licensing, Term of License.

 

f.                      The license shall expire biennially on March 31st after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on March 31st in accordance with the biennial licensing cycle.

 

5:2-19. Number of Machines; Fees.

 

The license issued under this Article, shall designate the number of coin-operated amusement machines allowed to be distributed under the particular license. The fee for the particular license shall be fixed at $750 $1,500 biennially.

 

The above license fees are fixed for the purpose of both regulation and revenue and shall be payable with the filing of the application, and if the application is rejected, the fee is to be returned to the applicant.

 

The license fee shall be payable upon the presentation of the application and shall be returned less the sum of $15 $30 in the event such license is not granted.

 

5:4. Miscellaneous Amusement Businesses

 

5:4-5. Issuance of License; Expiration Date.

 

b.                       All licenses issued, and renewals thereof, under this chapter shall expire biennially on March 31st after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on March 31st in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a Miscellaneous Amusement Business license.

 

5:4-6. License Fees.  

 

The fees to be paid biennially for a miscellaneous amusement business license are as follows:

 

For pool or billiard parlor with not more than 4 tables

$100 $200

For each additional table over 4

$50   $100

5:7. Public Dance Halls and Public Dance

 

5:7-4. Issuance of License; Term of License

 

c.                       All licenses issued, and renewals thereof, under this chapter shall expire biennially on March 31st after its date of issuance. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on March 31st in accordance with the biennial licensing cycle.  The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a public dance hall license

 

5:7-5.  License Fees.

 

c.                      Any room or place in which or that is connected with any other room or place in which alcoholic beverages are sold and dispensed; any room or place in which or that is connected with any other room and place in which dancing or exhibitions commonly called "cabaret" is conducted; and any room or place in which or that is connected with any other room or place which is conducted as a restaurant, hotel or motel, shall pay a biennial license fee according to the actual space used for the purpose of dancing, as follows:

 

                     Space less than 150 Feet                                                               $100 $200

 

                     Space 151 Square feet to 250 square feet inclusive $150 $300

 

                     Space over 250 Square Feet                                           $600 $1,200

 

5:11. Discotheques

 

5:11-4. Issuance of License and Term of License.

 

c.                      All licenses issued, and renewals thereof, under this chapter shall expire biennially on March 31st after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on March 31st in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a discotheque license.

 

5:11-5. License Fees.

 

c.                       Any room or place in which or that is connected with any other room or place in which alcoholic beverages are sold or dispensed; any room or place in which or that is connected with any other room or place in which dancing or exhibitions commonly called "cabaret" is conducted; any room or place which is conducted as a restaurant, hotel, motel, shall pay a biennial license fee according to the actual space used for the purpose of dancing, as follows:

 

1.  Space less than 150 square feet: $50 $100.

2.  Space 150 square feet - 250 square feet inclusive: $75 $150.

3.  Space over 250 square feet: $500 $1,000.

 

5:12. Social Clubs 

 

5:12-7. License Fee.

 

a.                      The application for a license required by this chapter shall be accompanied by a biennial license fee based on the following:

 

1.  Space less than 150 square feet: $100 $200.

2.  Space 150 square feet - 250 square feet inclusive: $150 $300.

3.  Space over 250 square feet: $300 $600.

 

5:12-8. Issuance of License; Terms of License.

 

c.                      All licenses issued, and renewals thereof, under this chapter shall expire biennially on October 31st after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on October 31st in accordance with the biennial licensing cycle. The Division of Tax Abatements and Special Taxes shall establish administrative rules and/or regulations pertaining to the issuance of a social club license.

 

SECTION 2:                      Title VI, Animal and Fowl, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, is revised and creates the following:

 

6:1. Domestic Animals

 

6:1-32. Duration of License and Registration.

 

All licenses issued, and renewals thereof, under this chapter shall expire biennially on December 30th after its date of issuance. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on December 30th in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a dog license and registration tags.

 

6:1-44. Duration of License.

 

All licenses issued, and renewals thereof, under this chapter shall expire biennially on December 30th after date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on December 30th in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a dog license and registration tags.

 

6:1-45. License Fees; No Fee or Shelter or Pound.

 

a.                      The annual biennial license fees for a kennel providing accommodation for 10 or less dogs shall be $25  $50 and for more than 10 dogs, $100 $200.

 

SECTION 3:                      Title VIII, Business and Occupations, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, is revised and creates the following:

 

8:1. Auctions and Auctioneers

 

8:1-8. Scope and Term of Licenses; Renewals.

 

c.                      All licenses issued, and renewals thereof, under this Chapter shall expire biennially on April 30th after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on April 30th in accordance with the biennial licensing cycle.  The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a public auctioneer's license.

 

8:1-9. License Fees.

 

The annual biennial fee for the license required by this Article shall be $150 $300 for a public auctioneer and a like amount for any establishment conducting a public auction business. The fee shall be payable upon the presentation of the application and shall be returned, less the sum of $10 $20 in the event such license is not granted.

 

If the term for which such license is sought shall be less than one year, the fee shall nevertheless be $150.

 

8:1-24. Issuance of License; Transferability; License Fee.

 

c.                      The license fee shall be $100 $200 which shall be payable biennially upon the presentation of the application and shall be returned in the event the application is not granted.

 

8:2 Automobile Parking Lots Open to the General Public

 

8:2-8. Term of License; License Fee.

 

a.                       All licenses issued, and renewals thereof, under this chapter shall expire biennially on September 30th after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on September 30th in accordance with the biennial licensing cycle.  The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a parking lot license

 

b. The annual biennial license for the operation of an open air parking lot shall be computed at the rate of $0.04 $0.08 per square foot of the total area occupied by the parking lot.

 

c. The annual biennial license fee for the operation of an enclosed parking lot (building) shall be computed as to its capacity as follows:

 

1.                       Each parking building which has the capacity to hold not more than 50 vehicles will be $150 $300.

 

2.                       Each parking building which has the capacity to hold 50 vehicles but not more than 100 vehicles will be $225 $450.

 

3.                       Each parking building which has the capacity to hold more than 100 vehicles will be $350 $700.

 

 

8:8 Junk and Scrap Metal Processing Facilities

 

8:8-5. License Fee; Expiration of License.

 

a.                      The fee for a junk shop, junkyard or metal processing facility license issued under this Article shall be $750 $3,000.00.

 

1.                     The biennial fee for a metal processing facility license issued under this Article shall be $1,000 for the year 2017 and $1,500 $3,000 thereon beginning April 30, 2018.

 

b. All licenses issued, and renewals thereof, under this Article shall expire on April 30th after its date of issuance. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of junk and scrap metal licenses as appropriate.

 

c. b.                     The license fee shall be payable biennially upon the presentation of the application and shall be returned less the sum of $50 $100 in the event such license is not granted.

 

d. The fee for a junk shop, junkyard or metal processing facility issued under this Article shall be $1,000.

 

1.  c.                      All licenses issued, and renewals thereof, under this Article shall expire biennially on April 30th after its date of issuance. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on April 30th in accordance with the biennial licensing cycle.  The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a junk shop, junkyard or metal processing facility license.

 

8:11.  Public Markets

 

8:11-5. Issuance of Public Market License; Fee; Term.

 

a.                      The Director is hereby authorized to issue a license to any public market. This license shall be applied for by its operator but shall be individual and separate for each public market an operator may establish or maintain. Such license may be issued upon the payment of a fee of $500 per year $1,000 biennially. All licenses issued, and renewals thereof, under this chapter shall expire biennially on December 30th after its date of issuance. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on December 30th in accordance with the biennial licensing cycle.  The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a public market operator's license. The fee shall be payable upon presentation of the application and shall be returned less the sum of $50 $100 in the event the license is not granted.

 

8:11-7. Issuance of Vendor’s License For A Public Market; Fee; Term. 

 

a.                      The Director of Finance is hereby authorized to issue a license for a public market to any vendor. This license shall be applied for by the vendor. Such license may be issued upon the payment of a fee of $250 per year $500.00 biennially and shall expire biennially on December 30th after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on December 30th in accordance with the biennial licensing cycle.  The fee shall be payable upon presentation of the application and shall be returned less the sum of $25 $50 in the event the license is not granted.

 

8:12.  Restaurants and Retail Sales and Service Establishments

 

8:12-5. Licensing Period; Renewal

 

All such licenses issued under this chapter shall be valid from the 1st day of February of the year in which the license is issued, until the 31st day of January of the following year on a biennial basis, unless sooner revoked or suspended. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on January 31st in accordance with the biennial licensing cycle.  All restaurant operators licensed under the provisions of this chapter must apply for a renewal license prior to the expiration of his or her current license. The renewal application shall include all listed items of Section 8:12-3a of this chapter and the fee for the renewal license shall as outlined in Section 8:12-6. Prior to the issuance of a renewal license, the premises to be licensed shall be inspected by the Department of Health and Community Wellness and the Division of Fire. Upon the receipt of a satisfactory inspection by the Health and Community Wellness and the Division of Fire, the Director shall determine whether to approve or deny a renewal application. If a renewal application is denied, the Director shall issue a written statement to the applicant explaining why the renewal application was not approved. Once the reasons for denial have been remedied, the applicant may reapply for a license according to Section 8:12-3.

 

8:12-6. License Fee; Exemptions.

 

The biennial fee for a restaurant license issued under this chapter shall be as follows:

 

                     Eatery with no seating fee                      $200 $400

                     Restaurants with seating capacity of 25 persons or less $150 $300

                     Restaurant with seating capacity of 26 to 50 persons $250 $500

Restaurant with seating capacity of up to and including 50 persons $300 $600

Restaurants with seating capacity of more than 50 persons $400 $800

Restaurants located in Downtown Family and Entertainment District] $500 $1,000

Restaurants operating 24 hours a day $1,500 $3,000

                     Eatery operating 24 hours a day $1500 $3,000

 

8:13 Retail Florists

 

8:13-6. License Fee; Expiration Date.

 

a.                       The applicant shall pay a biennial license fee of $200 $400 prior to the issuance of the license.

 

b.                      All licenses issued, and renewals thereof, under this chapter shall expire biennially on March 31st after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on March 31st in accordance with the biennial licensing cycle.  The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a retail florist's license.

 

8:14. Shoe Shine Parlors and Cigar Stores

 

8:14-5. Expiration Date.

 

Unless sooner revoked or suspended, all licenses issued, and renewals thereof, under this chapter shall expire biennially on January 31st after its date of issuance. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on January 31st in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a shoe shine parlor license.

 

8:14-6.

 

a.                       The biennial fees of a cigar store or shoe shine parlor license issued under this chapter shall be as follows:

 

Shoe shine parlor

$50 $100

Cigar store

$50 $100

The fee shall be payable upon the presentation of the application and shall be returned to the applicant, less the sum of $5 $10 in the event the license is not granted.

 

8:15. Transient Merchants and Itinerant Vendors

 

8:15-10. License Fee; Duration of License.

 

Upon payment by an applicant to the Director of the biennial sum of $1,000 $2,000 the Director is authorized to issue a license as a transient merchant or itinerant vendor provided that such applicant shall otherwise comply with the provisions of this chapter. Such license shall continue in favor of the person to whom it is issued for a period of 180 days from the day of issue.

 

8:16. Used Clothing Stores

 

8:16-6. License Fees; Term of License.

 

a.                      The annual biennial fee for used clothing store license or any renewal thereof shall be $100 $200 except that no license fee shall be charged to eleemosynary institutions

 

b.                      The term of the license or renewal thereof shall be one year two years from the date of issuance.

 

 

8:17. Used Motor Vehicle Sales Lots

 

8:17-6. Term of License; License Fee.

 

a.                      All licenses issued, and renewals thereof, under this chapter shall expire biennially on December 31st after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on December 31st in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a used motor vehicle sales lot license

 

b.                       The annual biennial fee for the license issued under this chapter shall be computed at the rate of $0.01 $0.02 per square foot of the area of the lot, with a minimum fee of $500 $1,000. When an application is received for any year for a lot coming into operation after January 1, 1992, the annual biennial fee shall be pro-rated at the rate of one-twelfth of the annual fee for each month or part thereof of the unexpired period of the year, but the pro-rated result is not to be less than $15 $30.

 

8:19. Wreckers

 

8:19-2. Wreckers Licenses.

 

No person shall operate or cause to be operated a wrecker upon the streets of the City of Newark without first obtaining a license from the Division of Tax Abatements/Special Taxes. All licenses issued, and renewals thereof, under this chapter shall expire biennially on May 31st after its date of issuance. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on May 31st in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a wrecker operator's license. The annual biennial fee for such license shall be $150 $300.

 

8:20. Public Garages

 

8:20-6. Term of License; License Fee; Renewal of License.

 

a.                      All licenses issued, and renewals thereof, under this chapter shall expire biennially on April 30th after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on April 30th in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of Public Garages Licenses as appropriate

 

b.                      The annual biennial fee for the license issued under this chapter shall be $200 $400 payable when the application is filed. In the event the license is not granted the application fee, less the sum of $15 $30 shall be returned to the applicant

 

8:21. Building Contractors

 

8:21-5.

 

a.                      Upon filing the application, the applicant shall pay the fee stated in the fee section for such license or for licensing after revocation of a license previously issued to such applicant in accordance with this chapter. After final review and approval of the application, all licenses issued, and renewals thereof, under this Chapter shall expire biennially November 30th after its date of issuance. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on November 30th in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a contractor's license

 

8:21-6. Term of License; License Fee; Renewal of License.

 

Such license shall be renewed by the City upon payment of the annual biennial renewal fee of $175 $350 renewal to be one year two years from the date of renewal. Upon failure to renew any license on or before expiration date, any subsequent license shall constitute a new or original license subject to the filing of a new application in accordance with the provisions of this chapter and payment of the fee specified in Section 8:21-3 hereof.

 

8:22. Tire Repair Shops

 

8:22-6. License Fee, Term of License, Renewal of License.

 

a.                      All licenses issued, and renewals thereof, under this chapter shall expire biennially on April 30th after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on April 30th in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of Tire Repair Shop Licenses as appropriate.

 

b.                      The fee for the license issued under this chapter shall be$250 $500 payable when the application is filed. In the event the license is not granted the application fee, less the sum of $15 $30 shall be returned to the applicant.

 

8:23. Precious Metals and Gems

 

8:23-4. License Fee (Commencement and Expiration of License).

 

a.                       Any fees previously established shall be in addition to the fee or cost associated with the Dealers obligation to comply with Section 8:23-8 of this Chapter mandating the electronic reporting of all transactions.

 

b.                      All licenses issued, and renewals thereof, under this chapter shall expire biennially on April 30th after its date of issuance. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of a precious metals and gems purchaser’s license.

 

8:26. Hub Cap Business Licenses for the Sale of New and Used Automobile Hub Caps

 

8:26-5. License Fee, Term of License, Renewal of Licenses.

 

a.                       All licenses issued, and renewals thereof, under this chapter shall expire biennially May 31st after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on May 31st in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling of the issuance of a vendor's license under this Subsection.

 

b.                      The annual biennial fee for the license issued under this chapter shall be $100 $200 payable when the application is filed. In the event the license is not granted the application fee, less $15 $30, shall be returned to the applicant.

 

8:28. Laundries and Dry Cleaning and Dyeing Plants

 

8:28-3. License Fee.

 

a.                      Every person operating or conducting any laundry, launderette, or cleaning or dyeing establishment or installation shall pay an annual biennial license fee of $100 $200.

 

b.                      Every person operating or conducting any coin operated dry cleaners or launderette shall pay an annual a biennial license fee of $50 $100 for each machine, the maximum sum of which shall not exceed $200 $400.

 

c.                      Laundry operating 24 hours a day or past the normal hours of operation shall pay an annual biennial license fee of $1,500 $3,000.

 

8:28-4. Duration of License.

 

All licenses and renewals thereof shall expire biennially May 30th after its date of issuance.

 

8:34. Retail License

 

8:34-1. Issuance; Renewal; Expiration; Administrative Rules.

 

All licenses issued, and renewals thereof, under this chapter shall expire biennially March 31st after its date of issuance. If any applicant obtains an initial license pursuant to this section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on March 31st in accordance with the biennial licensing cycle. The Division of Tax Abatements/Special Taxes shall establish administrative rules and/or regulations pertaining to scheduling for the issuance of retail licenses as appropriate.

 

8:34-2. Annual Biennial Fee

 

The annual biennial fee for the license issued under this chapter shall be $250 $500. In the event that the license is not granted the fee shall be returned less the sum of $15 $30.

 

8:35. Bakeries

 

8:35-1. Issuance; Renewal; Expiration; Administrative Rules.

 

All license issued, and renewals thereof under this chapter shall expire biennially March 31st after its date of issuance. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on March 31st in accordance with the biennial licensing cycle. The Division of Tax Abatement/Specials Taxes shall establish administrative rules and/or regulations pertaining to scheduling for issuance of Baker Licenses as appropriate.

 

8:35-2 - Annual Biennial Fee

 

The annual biennial fee for the license issued under this chapter shall be $150 $300. In the event that the license is not granted the fee shall be returned less the sum of $15 $30.

 

SECTION 4:                      Title XIII, Food, Drugs and Cosmetics, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, is revised and creates the following:

 

13.4 Milk and Milk Products

 

13:4-7. Term of License; Annual Biennial Renewal.

 

All licenses issued, and renewals thereof, under this chapter shall be for a period of one year two years from the date of issuance.

 

13:4-8. License Fee.

 

The fee for license required by Section 13:4-2 shall be $10 $20 for each store or other place where milk or fluid milk products are sold, distributed, kept for sale or offered for sale and $5 $10 for each wagon, automobile or other vehicle from which milk or fluid milk products are sold or delivered.

 

13:4-81. License Application; Issuance; Fee; Term; Separate License For Each Machine.

 

The license shall be issued by the Division of Tax Abatement and Special Taxes on application made by the person, firm or corporation, in occupancy of the premises, in or on which the machine is to be maintained and operated except where the location of the machine is in or on a Federal, State, County or municipal owned or operated premises, in which case, the vending machine owner shall make the application and receive the license. The annual biennial license fee shall be $100 $200 for each location at which an operator operates or maintains a milk, milk product, food or beverage vending machine subject to the ordinance, and the annual biennial license fee shall be $50 $100 for each such machine which dispenses milk and/or milk products as defined in N.J.S.A. 24:10-57.1 et seq., in which case the license fee for each machine shall be $75 $150. All licenses issued, and renewals thereof, under this chapter shall be for a period of one year two years from the date of issuance.

 

13:7. Meat, Meat Products and Meat Establishments

 

13:7-3. License For Slaughtering or Processing Required; Fee.

 

No person shall engage in the business of slaughtering, packing, canning or processing, or rendering edible meat or shall utilize inspection services furnished by the Department of Health and Community Wellness except as provided and authorized by this chapter and without first having obtained a license from the Department of Health and Community Wellness. The license shall run for a term of one year two years from the date of its issuance. The annual  biennial license fee for engaging in such business shall be $50 $100.

 

13:7-4.Renewal of License

 

The license required by Section 13:7-3 shall be renewed annually biennially. Any establishment which does not engage in the regular routine of business for which the license was issued for a period of two consecutive years from the expiration date of its last license shall be deemed to be no longer in business. Before any new license may be issued or a re-inspection service renewed, the establishment must make another application in the Division of Health to be granted inspection.

 

13:8. Ice

 

13:8-3. Permit; Application; Fee; Duration.

 

b.                      Before such permit is granted, the applicant shall pay to the City a fee of $10 $20.

 

c. Every such permit, unless sooner forfeited or revoked, shall expire biennially on the thirty-first day of December next succeeding the date when it was granted. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicant’s license will thereafter expire on December 31st in accordance with the biennial licensing cycle.

 

SECTION 5: Title XX, Offenses, Miscellaneous, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, is revised and creates the following:

 

20:4. Burglar and Robbery Alarms

 

20:4-8. Permits

 

Upon complying with the registration requirements of this chapter, a permit shall be issued to the user or owner by the Division of Tax Abatement and Special Taxes for the alarm system for each property, building or other facility and no permit shall be transferred or assigned.

 

An annual biennial fee of $50 $100 shall be charged for each permit. However, owner occupied one to four family residential units shall be exempt from the annual biennial fee requirement.

 

It shall be a violation of this chapter to install or use a burglar or robbery alarm system without a permit issued pursuant to this section.

 

Every such permit, unless sooner forfeited or revoked, shall expire on the first day of July biennially succeeding the date when it was granted. If any applicant obtains an initial license pursuant to this Section after the renewal date or in between a biennial cycle, the applicant will pay a pro-rated application fee. The applicants’ license will thereafter expire on July 1st in accordance with the biennial licensing cycle.

 

SECTION 6.                     Any existing ordinance, or part thereof, inconsistent with this ordinance is hereby repealed to the extent of such inconsistency.

 

SECTION 7.  Severability.

If any section, paragraph, subparagraph, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the specific section, paragraph, subparagraph, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective.

 

SECTION 8.  This Ordinance shall take effect upon final passage and publications in accordance with the laws of the State of New Jersey.

Ordinance amending various Titles of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, adjusting the license renewal period and fee to match the new biennial licensing schedule for certain establishments.
