WHEREAS, Resolution 7R1-d adopted on February 15, 2023, by the Municipal Council authorized Purchasing Agent, QPA, to enter into and execute a contract with Northeast Sweepers and Rentals, Inc., 20 Montesano Road, Fairfield, New Jersey 07004, to provide Maintenance and Repair services to the City’s Street Sweepers in the amount not to exceed Nine Hundred Thousand Dollars and Zero Cents ($900,000.00) for a period not to exceed twenty-four consecutive months pursuant to N.J.S.A 40A:11-15; and
WHEREAS, prior to the execution of the contract, the Department of Public Works contacted the Division of Central Purchasing requesting to rescind the award to allow them to substantially revise the specifications to better meet the department’s needs; and
WHEREAS, the Purchasing Agent wishes to rescind the award pursuant to N.J.S.A 40A:11-13.2(d) due to the contracting unit substantially revising the specifications to better meet the department’s needs; and
WHEREAS, accordingly the QPA issued Notice to Rescind the award on June 1, 2023 (“Notice”); and said Notice is made a part hereof.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R1-d adopted on February 15, 2023 by Municipal Council awarding a contract to Northeast Sweepers and Rentals, Inc., 20 Montesano Road, Fairfield, New Jersey 07004 (“Contractor”), in an amount not to exceed Nine Hundred Thousand Dollars and Zero Cents ($900,000.00) for a period not to exceed twenty-four (24) consecutive months, pursuant to N.J.S.A. 40A:11-15 is hereby rescinded and the award with the Contractor is null and void.
STATEMENT
This Resolution rescinds Resolution 7R1-d adopted on February 15, 2023, for the award of a Contract to Northeast Sweepers and Rentals, Inc., 20 Montesano Road, Fairfield, New Jersey 07004, to provide Maintenance and Repair: Street Sweepers for the Department of Public Works, Division of Public Buildings, in an amount not to exceed Nine Hundred Thousand Dollars and Zero Cents ($900,000.00) for a period not to exceed twenty-four (24) consecutive months, pursuant to N.J.S.A. 40A: 11-15, due to the City’s desire to substantially revise the specifications.
