This Resolution ratifies and authorizes the City of Newark to amend the grant award amount and request an extension from NJDOT to allow the City of Newark additional time to award a contract for construction of the Bikeway Program for the Newark Downtown Connector from December 11, 2024 through June 12, 2025.

WHEREAS, the State of New Jersey Department of Transportation (NJDOT) FY 2023 Bikeways State Aid Program provides municipalities with grant funding for bicycle lane projects; and
WHEREAS, on July 1, 2022, the Director of the Department of Engineering, on behalf of the City of Newark (the “City”), submitted an application to NJDOT requesting grant funding from the Bikeway State Aid Program for the Newark Downtown Connector within the City of Newark, identified as application BIKE-2023 Newark Downtown Connector for City of Newark with no City funds required; and
WHEREAS, on August 3, 2022, the Municipal Council adopted Resolution 7R3-a ratifying and authorizing the Director of the Department of Engineering to apply for, accept, and enter into grant documents for a grant award for the Newark Downtown Connector; and
WHEREAS, on December 12, 2022, NJDOT announced that the City was selected to receive a grant award in the amount of Three Hundred Seventy-Nine Thousand Dollars and Zero Cents ($379,000.00) for the construction of Bikeway State Aid Program for the Newark Downtown Connector; and
WHEREAS, NJDOT requires the City to award the contract for construction of Bikeway Program for Newark Downtown Connector within two (2) years of the announcement of the receipt of a grant award, with a deadline of December 11, 2024; and
WHEREAS, due to the additional design and coordination for utility infrastructure, the award has been delayed; and
WHEREAS, the City of Newark wishes to request that the NJDOT allow the City of Newark additional time to award the contract for construction of the Bikeway Program for the Newark Downtown Connector, extending the deadline from December 11, 2024 to June 12, 2025.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to request an extension from NJDOT to allow the City of Newark to award a contract for construction of Bikeway State Aid Program for the Newark Downtown Connector by June 12, 2025.
2. The grant award amount is hereby amended to Three Hundred Seventy-Nine Thousand Dollars and Zero Cents ($379,000.00).
3. The Municipal Council hereby ratifies its authorization of this extension request from December 12, 2022 to the date of adoption of this authorizing Resolution (June 12, 2025).
4. All other terms and conditions of the grant award from the NJDOT for Bikeway State Aid Program for Newark Downtown Connector project shall remain in force and effect until the contract is completed.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering to request an extension from NJDOT to allow the City of Newark to award a contract for construction of Bikeway State Aid Program for Newark Downtown Connector by June 12, 2025. No municipal funds are required.
