WHEREAS, the Newark Workforce Development Board (hereinafter “NWDB”), is a 501(c)(3) non-profit organization; and

 

WHEREAS, the NWDB’s mission is to lead and empower the City of Newark’s workforce system by leveraging assets and resources to ensure the educational, professional and economic success of Newark residents, and the prosperity of businesses in our community; and

 

WHEREAS, the NWDB, under the direction of Mayor Ras J. Baraka’s Office of Workforce Development, is responsible for strategic policy and oversight of the City of Newark’s workforce development; and 

 

WHEREAS, the NWDB planned to raise funds towards the procurement of a mobile unit vehicle to deliver employment, education, and training services offered by the City of Newark to the Residents in their neighborhoods (Workforce On Wheels (“WOW”) mobile one stop unit vehicle or “WOW mobile unit”); and

 

WHEREAS, the total cost of the mobile one stop unit vehicle is Three Hundred Seventy-Four Thousand Two Hundred Sixteen Dollars and Zero Cents ($374,216.00), and the invoice for the same is attached; and

 

WHEREAS, the NWDB raised Two Hundred Fifty-Eight Thousand Four Hundred Seventy-Seven Dollars and Thirty-Three Cents ($258,477.33) towards the purchase of a one stop mobile unit vehicle; and

 

WHEREAS, the remaining costs of One Hundred Fifteen Thousand Seven Hundred Thirty-Eight Dollars and Sixty-Seven Cents ($115,738.67) related to equipment and fitting of the WOW mobile unit with the technological and operational features and/or functionality required to service residents in a mobile workforce capacity; and

 

WHEREAS, on or about December 7, 2020, by email, the NWDB sought authorization from the New Jersey Department of Labor and Workforce Development Assistant Commissioner, to utilize Workforce Innovation Opportunity Act (hereinafter “WIOA”) grant funds awarded to the City of Newark to cover the balance of the mobile vehicle, specifically for the equipment and fitting of the WOW mobile unit with the technological and operational features and/or functionality required to service residents in a mobile workforce capacity itemized in the invoice  in the amount of One Hundred Fifteen Thousand Seven Hundred Thirty-Eight Dollars and Sixty-Seven Cents ($115,738.67) (copy of the invoice and email attached); and

 

WHEREAS, on December 15, 2020, the NWDB submitted a formal request to the New Jersey Department of Labor and Workforce Development Assistant Commissioner seeking approval to utilize WIOA funds towards the WOW mobile unit (correspondence attached); and

 

WHEREAS, the New Jersey Department of Labor and Workforce Development Assist Commissioner responded to the request with a formal notice approving the NWDB’s request to utilize One Hundred Fifteen Thousand Seven Hundred Thirty-Eight Dollars and Sixty-Seven Cents ($115,738.67) of WIOA funds for mobile unit costs as invoiced (a copy of the approval letter is attached); and

 

WHEREAS, One Hundred Fifteen Thousand Seven Hundred Thirty-Eight Dollars and Sixty-Seven Cents ($115,738.67) of WIOA grant funds were utilized towards the equipping and fitting of the WOW mobile vehicle as itemized in the invoice; and

 

WHEREAS, the WOW mobile unit is expected to be completed and delivered in November 2021; and

 

WHEREAS, upon receipt of the WOW mobile unit, the NWDB is gifting/donating the WOW mobile unit, with an invoiced value of Three Hundred Seventy-Four Thousand Two Hundred Sixteen Dollars and Zero Cents ($374,216.00), to the City of Newark; and

 

WHEREAS, the intent of this effort is to develop and drive workforce development within the City of Newark by delivering information, program resources, and employment opportunities directly into resident communities; and

 

WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America; and

 

WHEREAS, NWDB fully understands and agrees that they are not entitled to receive any direct benefit from the City of Newark in exchange for its gift; and

 

WHEREAS, the Mayor’s Office of Workforce Development desires to accept the gift of a mobile unit vehicle, pursuant to N.J.S.A. 40A:5-29.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designees, the Business Administrator, are authorized, pursuant to N.J.S.A. 40A:5-29, to accept the gift/dodnation of a mobile unit vehicle to deliver employment, education, and training services offered by the City of Newark to residents in their neighborhoods (Workforce On Wheels (“WOW”) mobile one stop unit vehicle, with an estimated value of Three Hundred Seventy-Four Thousand Two Hundred Sixteen Dollars and Zero Cents ($374,216.00).

 

2.                     No municipal funds will be expended for the acceptance of this gift other than $115,738.67 of WIOA grant funds authorized and approved by the New Jersey Department of Labor and Workforce Development Assistant Commissioner for equipping and fitting the WOW mobile unit with the technological and operational features and/or functionality required to service residents in a mobile workforce capacity and costs relating to the operation of the WOW mobile unit as part of NewarkWORKS continuing operations and workforce development initiatives are expected for the WOW mobile unit (i.e. Drivers, insurance purchase, ongoing maintenance, etc.).

 

 

STATEMENT

 

This Resolution authorizes the Mayor of the City of Newark, and/or his designee, the Business Administrator to accept a gift/donation from the Newark Workforce Development Board, 990 Broad St., Newark, New Jersey 07102, of a Workforce On Wheels (“WOW”) Mobile Unit vehicle to deliver employment, education, and training services offered by the City of Newark to the Residents in their neighborhoods with an estimated value of $374,216.00, with no municipal funds to be expended, other than $115,738.67 of WIOA grant funds authorized and approved by the New Jersey Department of Labor and Workforce Development, Assistant Commissioner for equipping and fitting the WOW mobile unit with the technological and operational features and/or functionality required to service residents in a mobile workforce capacity and costs relating to the operation of the WOW mobile unit.
