WHEREAS, the Department of Child and Family Well-Being of the City of Newark, has a need to enhance surveillance in communicable disease and childhood immunization rates as a non-fair and open contract pursuant to the provision of N.J.S.A. 19:44A-20.5 et seq. and the City of Newark Executive Order of Pay-to-Play Reform MEO-07-0001; and
 
WHEREAS, UMDNJ has completed and submitted a Business Entity Disclosure Certification and City of Newark Political Contribution Form which certifies that UMDNJ has not made any reportable contributions to a political or candidate committee in the previous year, and that the contract will prohibit UMDNJ from making any reportable contributions through the term of this contract; and
 
WHEREAS, the City of Newark wishes to enter into a Professional Services contract with UMDNJ, located at 185 South Orange Avenue, Newark, New Jersey 07103, to provide the City of Newark with services for the Immunization/ Project Vaccinate Program in an amount not to exceed $125,000.00, for the period of January 1, 2012 through December 31, 2012; and
 
WHEREAS, the Local Public Contracts Law (N.J.S.A.40A:11-1 et seq.) requires that the resolution authorizing the award of a contract for "Professional Service" without competitive bidding must be published in a local newspaper; and
 
WHEREAS, this contract has been determined and certified in writing to have a value in excess of $17,500.00, and is being awarded as a non-fair and open contract pursuant to N.J.S.A.19:44A-20.5 et seq.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Director of the Department of Child and Family Well-Being are hereby authorized to enter into and execute a Professional Services contract with UMDNJ, located at 185 South Orange Avenue, Newark, New Jersey 07103, to develop and implement an epidemiologically-based surveillance system to accurately assess the immunization rates in pre-school and school aged children and adolescents residing in the city of Newark and provide the City of Newark with communicable disease surveillance, Immunization/Project Vaccinate, in the amount not to exceed $125,000.00, for the period of January 1, 2012 through December 31, 2012.
 
2.      This contract is being awarded pursuant to the non-fair and open procedures of the Pay-to-Play Law N.J.S.A. 19:44A-20.5 et seq., and the City of Newark Executive Order on Pay to Play Reform, MEO-07-0001 and pursuant to the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-5(1)(a)(i)) because these services are to be rendered by a person (or persons) whose performance requires knowledge of an advance type in a field of learning acquired by a prolonged formal course of specialized instruction and study, as distinguished from general academic instruction, N.J.S.A.40A:11-5(I).
 
3.      UMDNJ has completed and submitted a Business Entity Disclosure Certification and City of Newark Political Contribution Form which certifies that UMDNJ has not made any reportable contributions to a political or candidate committee in the previous year, and that the contract will prohibit UMDNJ from making any reportable contributions through the term of this contract.
 
4.      This Contract is ratified from January 1, 2012 to the date of adoption of this resolution.
 
5.      Attached hereto is a Certification of Funds in the amount of $125,000.00 from the Municipal Comptroller of the City of Newark which states (1) that there are sufficient funds for the purpose set forth hereinabove; (2) that line appropriation of the official budget which shall be charged is Business Unit 051; Dept. ID G12; Division 2H2EO; Account 71280.
 
6.      The executed contract, Business Disclosure Entity Certification, City of Newark Political Contribution Form and the Determination of Value shall all be placed on file along with the original resolution in the Office of the City Clerk by the Department of Child and Family Well-Being.
 
7.      No changes to this contract are allowed without prior Municipal Council approval.
 
8.      A notice of this action shall be published in the newspaper as required by law within ten (10) days of its passage.
 
9.      There shall be no advance payments made against this contract in accordance with N.J.A.C. 40A:5-16.
 
STATEMENT:
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Child and Family Well-Being to enter into and execute a Professional Services contract with UMDNJ, located at 185 South Orange Avenue, Newark, New Jersey 07103, to develop and implement an epidemiologically-based surveillance system to accurately assess the immunization rates in pre-school and school aged children and adolescents residing in the City of Newark, in the amount not to exceed $125,000.00, for the period of January 1, 2012  through December 31, 2012.
