WHEREAS, on November 20, 2025, pursuant to N.J.S.A. 40A:11-4.1 et seq. and N.J.A.C. 5:34-9.4 et seq., the City of Newark, through its Qualified Purchasing Agent, QPA, advertised to solicit proposals from contractors to provide Operation of a Restaurant Concession at Military Park in the City of Newark, as described in the attached Request for Proposals (“RFP”) package; and
WHEREAS, the Division of Central Purchasing published the RFP on the City of Newark’s electronic procurement portal to provide broader access and download capability to potential bidders; and
WHEREAS, via the electronic procurement portal, twenty-eight (28) RFP packages were downloaded by prospective bidders following the date of advertisement. On December 11, 2025, two (2) proposals were received in response; and
WHEREAS, pursuant to the competitive contracting process, a four (4) members evaluation committee was formed to review the proposals received and make award recommendation, as outlined in the RFP; and
WHEREAS, the Purchasing Agent obtained signed non-conflict letters from the members of the evaluation committee before releasing the RFP responses to the evaluators via the electronic procurement portal; and
WHEREAS, the Proposals Review Committee evaluated the responses from Burger Walla, LLC, 47 Halsey Street, Newark, NJ 07102, and Triple C-3 C, LLC, 4 Branford PL 2, Newark, NJ 07102, in accordance with the evaluation criteria stated in the RFP; and
WHEREAS, the Proposals Review Committee recommended that an award be made to Burger Walla, LLC, 47 Halsey Street, Newark, NJ 07102, deemed the most advantageous with price and other factors considered; and
WHEREAS, the Purchasing Agent concurs with the evaluation committee recommendation that a contract award be made to Burger Walla, LLC, for the reasons stated; and
WHEREAS, based on the proposals received as a result of the competitive contracting process, during the contract period (including the one-year extension), the restaurant concession at Military Park has an estimated value between one hundred forty-six thousand dollars ($146,000) and one hundred eighty-five thousand dollars ($185,000.00); and
WHEREAS, this contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5; and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator and/or the Purchasing Agent, are hereby authorized to enter into a contract with Burger Walla, LLC, 47 Halsey Street, Newark, NJ 07102 for the Operation of a Restaurant Concession at Military Park, at an amount equal or greater than thirty-six thousand ($36,000.00) dollars plus other revenue sharing items subjected to sales volume referred on the RFP.
2. The contract term will be established for a period not to exceed twenty-four (24) consecutive months upon a fully executed contract, with a one-year (1) option to renew.
3. The Municipal Council of the City of Newark hereby ratifies its authorization of the use of competitive contracting to procure services for the Operation of a Restaurant Concession at the City Military, consistent with State requirements.

5. The Qualified Purchasing Agent shall file a duly executed copy of the contract in the Office of the City Clerk.
6. If required by State law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10.
STATEMENT
This Resolution authorizes the Mayor and/or his designees, the Business Administrator and/or the Qualified Purchasing Agent, to enter into a contract with Burger Walla, LLC, 47 Halsey Street, Newark, NJ 07102 to serve as the Operator of a Restaurant Concession at Military Park at an amount equal or greater than thirty six thousand ($36,000.00) dollars plus other revenue sharing items subjected to sales volume referred on the RFP, for a period not to exceed twenty four (24) consecutive months upon a fully executed contract, with a one-year (1) option to renew.
