WHEREAS, the City of Newark Department of Public Safety, Office of Professional Standards (the “City”) is in need of office space to serve as a Police Substation; and

 

WHEREAS, Broad Street Fidelco, LLC (the “Owner”) is the fee owner of the office building known as 468-498 Broad Street, Newark, New Jersey (“Building”); and

 

WHEREAS, the City and the Owner are contemporaneously negotiating the terms of a long-term lease agreement for office space on the third (3rd) floor of the Building designated as Suite 302 (the “New Lease”) to serve as a Police Precinct Substation for the City of Newark’s Department of Public Safety, Office of Professional Standards; and

 

WHEREAS, until the New Lease is entered into and possession of the premises that is the subject of the New Lease is delivered to the City, the parties desire to provide for the licensing by Owner to City of the right to use and occupy, on a temporary basis, the office space on the ground floor of the Building; and 

 

WHEREAS, the Municipal Council adopted Ordinance 6SF-f at a Public Hearing, Second Reading and Final Passage on December 18, 2024 authorizing the City to license the office space on the ground floor of the Building, for the period of time until a New Lease is entered into and possession of the premises that is subject of the New Lease is delivered to the City for use as a Police Precinct Substation for the City of Newark’s Department of Public Safety, Office of Professional Standards; and

 

WHEREAS, N.J.S.A. 40:69A-181(b) provides that an ordinance goes into effect on the twentieth day after the date of its approval by the Mayor unless the Council, by resolution, declares an emergency; and

 

WHEREAS, the Municipal Council wishes to waive the 20 day waiting period as an emergency because said appropriation must be in place so that the City may move forward with executing the License Agreement for its Police Substation for the City to effectively and adequately protect its citizens.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     For the reasons set forth herein and the important public policies enunciated, an emergency is hereby declared to exist and Ordinance 6SF-f, authorizing a License Agreement permitting the City to use property as a Police Substation, once adopted by the Municipal Council after Public Hearing, Second Reading and Final Passage in accordance with N.J.S.A. 40:69A-181(b), due to the exigent need for the City to effectively and adequately protect its citizens.
