WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") Bikeway Grant Program provides funds to counties and municipalities to promote bicycling as an alternate mode of transportation in New Jersey. A primary objective of the Bikeway Grant Program is to support the State's goal of constructing 1,000 new miles, of dedicated bike paths (facilities that are physically separated from motorized vehicular traffic by an open space or barrier either within the highway right of way or within an independent right of way); and
WHEREAS, the City of Newark wants to provide bicycle access to Penn Station Newark from Ironbound through Riverfront Park by creating protected and shared bike lanes along Raymond Boulevard between Freeman Street and mid-block cross at Riverbank Park Newark; and
WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the NJDOT FY 2018 Bikeway Grant Program for the construction of protected and shared bike lanes along Raymond Boulevard between Freeman St and mid-block cross at Riverbank Park Newark connecting Penn Station Newark to Ironbound through Riverfront Park Newark; and
WHEREAS, on October 4, 2017, on behalf of the City of Newark, the Director of the Department of Engineering submitted an application to NJDOT requesting grant funding in the amount of $348,000.00 from the NJDOT FY 2018 Bikeway Grant Program for the construction of the Raymond Boulevard Barrier-Separated Bicycle Lanes project in the City of Newark, identified as application BIKE-2018-Raymond Boulevard Barrier Separate-00019, with no City funds required; and
WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing submission of the grant application; and
WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering desires to accept the grant award and execute a grant agreement governing said award and execute a grant agreement governing said award; and
WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering shall submit a copy of the grant agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit an electronic grant application identified as BIKE-2018-Raymond Boulevard Barrier Separate-00019 to the New Jersey Department of Transportation ("NJDOT") on behalf of the City of Newark requesting grant funding in the amount of $348,000.00 from the NJDOT FY 2018 Bikeway Grant Program for the construction of the Raymond Boulevard Barrier-Separated Bicycle Lanes project in the City of Newark, with no City funds required (a copy of the application is attached hereto and made a part hereof).
2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
3. Upon notification of the receipt of a grant award in connection with this application, the grant is hereby accepted.
4. Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the NJDEP to receive and expend the grant award for the construction of the Raymond Boulevard Barrier-Separated Bicycle Lanes project in the City of Newark.
5. Upon notification of the receipt of a grant award in connection with this application, the Director of Engineering shall submit a complete copy of the grant agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.
6. No municipal funds are required for receipt or acceptance of this grant award.
7. The Director of Department of Engineering shall file a fully executed copy of the grant application, grant award letter, and grant agreement in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to submit an electronic grant application identified as BIKE-2018-Raymond Boulevard Barrier Separate-00019 to the New Jersey Department of Transportation on behalf of the City of Newark requesting grant funding in the amount of $348,000.00 from the NJDOT FY 2018 Bikeway Grant Program for construction of the Raymond Boulevard Barrier-Separated Bicycle Lanes project in the City of Newark, with no City funds required.
