AN ORDINANCE AMENDING TITLE XXIII, TRAFFIC, CHAPTER 3, PROHIBITED TURNS, SECTION 23:3-3, RIGHT TURNS, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, BY PROHIBITING RIGHT TURNS FROM DR. MARTIN LUTHER KING, JR. BOULEVARD ON TO SUSSEX AVENUE (CENTRAL WARD).

                     WHEREAS, the Department of Engineering, Division of Traffic and Signals, has determined the intersection of Dr. Martin Luther King, Jr.  Boulevard, Sussex Avenue and Central Avenue intersection in the Central Ward qualifies for a “No Right Turn” from south on Dr. Martin Luther King, Jr.  Boulevard to the west on Sussex Avenue designation, in accordance with the Manual on Uniform Traffic Control Devices; and

 

                     WHEREAS, such designation will improve safety and avoid pedestrian and vehicle conflicts at the intersection; and

 

                     WHEREAS, the Division of Traffic and Signals desires to improve safety at the signalized intersection of Dr. Martin Luther King, Jr. Boulevard, Sussex  Avenue and Central Avenue intersection in Central Ward by prohibiting right turns from south on Dr. Martin Luther King, Jr. Boulevard to the west on Sussex Avenue.

 

                     NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

                     SECTION 1.                     Title XXIII, Traffic, Chapter 3, Prohibited Turns, Section 23:3-3, Right Turns, of the revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, by adding the following:

Dr. Martin Luther King, Jr. Boulevard                     South on Dr. Martin Luther King, Jr. 

Sussex Avenue, and Central Avenue                     Boulevard to west on Sussex Avenue

 

                     SECTION 2.                     Any existing Ordinances or parts thereof inconsistent with this Ordinance are hereby repealed.

 

                      SECTION 3.                     The Ordinance shall take effect take upon final passage and publication and in accordance with the laws of the State of New Jersey.

 

                      SECTION 4.                     The Ordinance does not require approval by Commissioner of Transportation.

 

                     SECTION 5. Codification. This Ordinance shall be a part of the Code of the City of Newark as though codified and fully set forth therein. The City Clerk shall have this Ordinance codified and incorporated in the official copies of the Code. The City Clerk and the Corporation Counsel are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Newark in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed. 

 

                                                    

STATEMENT

 

                     This Ordinance authorizes the Department of Engineering, Division of Traffic and Signals, to improve pedestrian safety at the signalized intersection of Dr. Martin Luther King, Jr. Boulevard, Sussex Avenue and Central Avenue (Central Ward), by prohibiting vehicles from making a right turn from Dr. Martin Luther King, Jr. Boulevard to Sussex Street, whenever an official sign is present prohibiting a such turn.
