WHEREAS, the New Jersey State Police (NJSP) maintains a Training Academy on the grounds of the National Guard Training Center in Sea Girt, New Jersey (Training Academy); and
WHEREAS, the Acting Director of the Department of Public Safety for the City of Newark (NPD) is responsible for the hiring of police officers and providing a Police Training Commission (PTC) approved academy for recruits to receive the Basic Course for Police Officers Training Program (BCPO Training Program); and
WHEREAS, the NJSP Training Academy is a PTC-approved training academy and has the ability to provide a residential training program for a maximum of two hundred (200) recruits; and
WHEREAS, in order to increase staffing levels, the NPD has requested that the NJSP Training Academy hold a Residential Academy Training Program to teach the BCPO Training Program to two hundred (200) newly hired NPD police officers selected by NPD; and
WHEREAS, pursuant to N.J.S.A. 53:1-27, the NJSP has the authority to provide training to county and municipal law enforcement officers; and
WHEREAS, the Commandant of the NJSP Training Academy, with the approval of the NJSP Superintendent, has agreed to conduct a single residential training academy class for a maximum of two hundred (200) newly hired NPD police officers to teach the BCPO Training Program; and
WHEREAS, the Mayor and the Acting Director of the Department of Public Safety of the City of Newark believe it is in the best interests of the Police Division and the residents of the City to utilize the NJSP Training Academy.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Acting Director of the Department of Public Safety is authorized to enter into and execute a Memorandum of Understanding with the Division of New Jersey State Police to provide residential Basic Course for Police Officers Training Program at the New Jersey State Police Training Academy in Sea Girt, New Jersey for two hundred (200) newly hired police officers to be held from August 7, 2017, through December 11, 2017. A copy of the Memorandum of Understanding is attached hereto.
2. The cost for the Residential Academy Training Program shall not exceed Two Thousand Five Hundred Dollars and Zero Cents ($2,500.00) per recruit for a total expenditure of Five Hundred Thousand Dollars and Zero Cents ($500,000.00).
3. Pursuant to N.J.A.C. 5:30-5.5(a), a Temporary Budget, attached hereto is the Chief Finance Officer’s Certification, which states partial funds in the amount of $15,000.00 are available in the 2017 Temporary Budget, from Account Number 71150, Police Division Training Account, the balance to be provided in the 2017 Adopted Budget.
4. The Acting Director of the Department of Public Safety shall file the Certification, along with the original resolution and the fully executed Memorandum of Understanding, in the Office of the City Clerk.
5. There shall be no amendments to the Memorandum of Understanding without the approval of the Municipal Council.
STATEMENT
This resolution hereby authorizes the Acting Director of the Department of Public Safety to enter into and execute a Memorandum of Understanding with the Division of New Jersey State Police to provide residential Basic Course for the Police Officers Training Program at the New Jersey State Police Training Academy in Sea Girt, New Jersey for two hundred (200) newly hired police officers to be held from August 7, 2017, through December 11, 2017, in an amount not to exceed Five Hundred Thousand Dollars ($500,000.00).
