WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") FY 2025 Bikeways Grant Program provides municipalities with grant funding for transportation improvements; and

WHEREAS, the City of Newark (the "City") seeks to obtain funding from the FY 2025 Bikeways Grant Program, to provide transportation improvements and bike lanes along Dr. Martin Luther King, Jr. Boulevard from Clinton Avenue to Orange Street; and

WHEREAS, the City intends to further the public interest by obtaining funding from the NJDOT FY 2025 Transit Bikeways Grant Program for the construction of transportation improvements and bike paths along Dr. Martin Luther King, Jr. Boulevard from Clinton Avenue to Orange Street; and

WHEREAS, on July 1, 2024, on behalf of the City of Newark, the Acting Director of the Department of Engineering, submitted an application, identified as BIKE-2025 Dr. Martin Luther King, Jr. Boulevard Bikeway project, to NJDOT requesting grant funding in the amount of One Million Four Hundred Forty-Seven Thousand Fifty Three Dollars and Twelve Cents ($1,447,053.12), from the NJDOT FY 2025 Bikeway Grant Program, for construction of the BIKE-2025-Dr.Martin Luther King Boulevard Bikeway Project; and

WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a Resolution from the Municipal Council authorizing submission of the grant application; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering desires to accept the grant award and execute a Grant Agreement governing said award; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering shall submit a copy of the Grant Agreement to the City Clerk, the Corporation Counsel and the Business Administrator for review, approval, and signature.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to submit an electronic grant application, identified as BIKE-2025-Dr.Martin Luther King Boulevard Bikeway Project, to the New Jersey Department of Transportation, on behalf of the City of Newark, requesting grant funding in the amount of One Million Four Hundred Forty-Seven Thousand Fifty-Three Dollars and Twelve Cents ($1,447,053.12) from the NJDOT FY 2025 Bikeway Grant Program, for construction of transportation and bikeway improvements along Dr. Martin Luther King, Jr. Boulevard from Clinton Avenue to Orange Street in the City of Newark, with no City funds required (a copy of the application is attached hereto and made a part hereof.)

2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing Resolution.

3. The Municipal Council of the City of Newark recognizes and accepts that the Department may offer a lesser or greater amount and therefore, upon receipt of the grant agreement from the New Jersey Department of Transportation, does further authorize the execution of any such grant agreement upon review, approval and signature by the City's Mayor and Corporation Counsel; and also, upon receipt of the fully executed agreement from the Department, does further authorize the acceptance of the grant funds and the expenditure of the funds pursuant to the terms of the agreement between the City of Newark and the New Jersey Department of Transportation.

4. Upon notification of the receipt of a grant award in connection with this application, the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award from the NJDOT FY 2025 Dr. Martin Luther King, Jr. Boulevard Bikeway Project in the City of Newark.

5. Upon notification of the receipt of a grant award in connection with this application, the Acting Director of the Department of Engineering shall submit a complete copy of the Grant Agreement and any associated documents to the City Clerk, Corporation Counsel and the Business Administrator for review, approval, and signature.

6. No municipal funds are required for receipt or acceptance of this grant award.

7. The Acting Director of the Department of Engineering shall file a fully-executed copy of the grant application, grant award letter, and grant agreement in the Office of the City Clerk.


STATEMENT

This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to submit an electronic grant application for, accept, and enter into an agreement for grant funding from the New Jersey Department of Transportation, in the amount of One Million Four Hundred Forty-Seven Thousand Fifty-Three Dollars and Twelve Cents ($1,447,053.12), from the NJDOT FY 2025 Bikeway Grant Program for construction of the Dr. Martin Luther King, Jr. Boulevard Bikeway Project in the City of Newark. No municipal funds are required for receipt or acceptance of this grant award
