To purchase emergency vehicle from City of Jersey City to replace Newark’s damaged Aerial Ladder.

 WHEREAS, the City of Jersey City (the City) owns a 2000 Emergency One model G115 H500 with vehicle identification number 4ENGABA8XY1001352 that was damaged beyond repair (the vehicle), which is equipped with a 2000 E-one 110” Aerial Ladder, that is no longer needed for its municipal purposes and was intended to be sold for scrap; and

 

 WHEREAS, the City of Newark, New Jersey (Newark) suffered damage to an Aerial Ladder on a 2003 fire truck which is beyond repair; and

 

WHEREAS, the City’s aerial ladder will fit the Newark fire truck to replace Newark’s damaged aerial ladder; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-36, sale or other disposition of personal property that is no longer needed for public purpose. . .  (2) The contracting unit need not advertise for bids when it makes any such sale to the United States, the State of New Jersey, another contracting unit, any body politic to which it contributes tax raised funds, any foreign nation which has diplomatic relations with the United States, or any governmental unit in the United States; and

 

WHEREAS, the Municipal Council of the City by resolution 19-323, approved on April 10, 2019, authorized the sale of unused fire safety equipment to the City of Newark for nominal consideration; and

 

WHEREAS, Newark had the opportunity to personally inspect the vehicle and Newark agrees to purchase the 2000 Emergency One model G115 H500 with vehicle identification number 4ENGABA8XY1001352 “As Is” for the sum of one dollar ($1.00); and

 

WHEREAS, the Purchasing Agent, QPA, recommends the purchase of the 2000 Emergency One model G115 H500 with vehicle identification number 4ENGABA8XY1001352 “As Is” for the sum of one dollar ($1.00) which will allow Newark to replace the damaged aerial ladder.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and or his designee, the Purchasing Agent, QPA, are authorized to execute an agreement with the City of Jersey City for the purchase of a 2000 Emergency One model G115 H500 with vehicle identification number 4ENGABA8XY1001352 “As Is” to replace Newark’s damaged aerial ladder, for the sum of one dollar ($1.00) for the period commencing upon the approval of this resolution by the Municipal Council until the date of complete delivery July 15, 2019.

 

2.                     The agreement between the City of Newark and the City of Jersey City is ratified from June 12, 2019 to the date of adoption of the authorizing resolution.

 

3.                     Any costs or expenses which may be incurred in the transfer of title and ownership of such vehicle and the transportation of the Vehicle to Newark will be processed through the operating budget of the Division of Motors at an estimated cost of Fifty-Dollars ($50.00).

 

4.                     There shall be no advance payment on this State contract in accordance with N.J.S.A. 40A:5-16.

 

5.                     The funding source is 2019 Budget/ NW011-011-190-1903-83830-B2019/ Department of Public Safety/Fire Division.

 

6.                     This contract is being awarded to the City of Newark from another municipality for less than $17,500.00, and as such is not governed by Local Pay-to-Play Law, N.J.S.A. 19:44A-20.5.

 

7.                     The Purchasing Division shall forthwith file a duly executed copy of the Agreement, attached hereto, in the Office of the City Clerk.

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Purchasing Agent, QPA, to purchase from the City of Jersey City a damaged 2000 Emergency One model G115 H500 with vehicle identification number 4ENGABA8XY1001352 “As Is” for the sum of one dollar ($1.00) to replace Newark’s damaged Aerial Ladder.
