                     WHEREAS, on March 10, 2021, the 117th Congress of the United States and President Joseph R. Biden officially enacted a $1.9 trillion stimulus package, the American Rescue Plan Act of 2021, in response to the economic crisis brought on by the ongoing Covid-19 pandemic; and

 

                     WHEREAS, the New Jersey Department of Community Affairs (“DCA”), has made available One Million Dollars ($1,000,000.00) for the Department of Public Safety, Fire Division; and

 

                     WHEREAS, the American Rescue Plan State Fiscal Recovery Funds (SFRF), is a unique opportunity for the City of Newark, Department of Public Safety, Fire Division to plan for its future and make significant investments for performing Fire Division services with the purchase of Fire Apparatus; and

 

                     WHEREAS, the City of Newark, Department of Public Safety, Fire Division (“City”) desires to further the public interest by obtaining funding from the SFRF for the purchase of two (2), or more, fire trucks to augment the City’s fleet and respond to calls throughout the City of Newark; and

 

                     WHEREAS, on October 31, 2024, on behalf of the City of Newark, the Director of the Department of Public Safety submitted an application to the DCA requesting grant funding in the amount of One Million Dollars and Zero Cents ($1,000,000.00) for the purpose stated above; and

 

                     WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Public Safety desires to accept the grant award and execute a grant agreement governing said award; and

 

                     WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Public Safety shall submit a copy of the grant agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature; and

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

                      1.                     The Mayor and/or his designee, the Director of the Department of Public Safety, Division of Fire, are hereby authorized to submit an electronic application via the Treasury Submission Portal for Coronavirus State and Local Fiscal Recovery Funds, on behalf of the City of Newark, requesting stimulus funding from the American Rescue Plan, to respond to the economic crisis brought on by the Covid-19 pandemic. (a copy of the submission confirmation is attached hereto and made a part hereof).

 

                     2.                     The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.

 

                     3.                     Upon notification of the receipt of a grant award in connection with the application, the grant is hereby accepted.

 

                     4.                     Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designee, the Director of the Department of Public Safety, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Community Affairs to receive and expend the grant award for the purchase of two (2), or more, fire trucks for the City of Newark’s fleet.

 

                     5.                     Upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Public Safety shall submit a complete copy of the grant agreement and any associated documents as well as a copy of the Certification of Funds for any required matching funds to both the Corporation Counsel and the Business Administrator for review, approval, and signature.                     

 

                     6.                     No municipal funds are required for receipt or acceptance of this grant award.

 

                     7.                     The Director of the Department of Public Safety Division of Fire shall file a copy of the fully-executed grant application, the grant award letter, the grant agreement, and a Transaction Summary from the New Jersey Department of Community Affairs in the Office of the City Clerk.

 

STATEMENT

 

                     This Resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Public Safety Division of Fire, to submit an application for, accept, and enter into an agreement for grant funding in the amount of $1,000,000.00, from the New Jersey Department of Community Affairs to further the public interest and safety by purchasing two (2), or more, additional fire trucks to respond to calls and emergencies within the City of Newark.  No municipal funds are required for acceptance of this award.
