The Department of Public Safety desires, as part of Smart Policing Initiative, to make this purchase of equipment, including installation and two (2) years of recurring annual Gateway costs as it relates to Homeland Security and Domestic Preparedness.

WHEREAS, the City of Newark, Department of Public Safety, Police Division, through its Purchasing Agent, QPA for the City of Newark wishes to purchase and have installed Five (5) VS Portable PTZ Security Units (V5-PSU-PTZ) with NEMA Enclosure, Pan Tilt Zoom Camera, Three (3) Solar panels, Live streaming (no ANALYTICS Streaming Video only) with Blue LED Indication light, including Five (5) PSU Gateway Licenses (Connectivity Software Updates) and 2 years of recurring annual Gateway costs; and
WHEREAS, the State 2004 Appropriations Act, P.L. 2004, c. 71, Division of Government Services (DLGS), Local Finance Notice No. 2004-21 and “Option No. 4” in DLGS Local Finance Notice No. 2009-20 allow local units to purchase goods from certain federal government contracts without the requirement for public bidding pursuant to the Local Public Contacts Law; and
WHEREAS, the Director of the Department of Public Safety and the Purchasing Agent, QPA, for the City of Newark conclude that bidding is not practicable in order to meet acquisition timing or other criteria appropriate to the circumstances; and
WHEREAS, the desired services and/or items are not available through State contract or other in-State procurement; and
WHEREAS, N.J.S.A 52:34-10.6(c) authorizes the City to purchase equipment and or services related to homeland security, domestic preparedness which are paid for or reimbursed by federal funds awarded by the United States Department of Homeland Security without public bidding if the contractor either: (1) is a holder of a current State contract for the equipment, or (2) is participating in a federal procurement program established by a federal department or agency, or (3) has been approved by the State Treasurer in consultation with the New Jersey Domestic Security Preparedness Task Force; and
WHEREAS, Johnson Controls, Inc., 264 Fernwood Avenue, Edison, New Jersey is participating in a federal procurement program established by a federal department or agency and is the holder of General Service Administration Contract GS-07F-190CA “Schedule 84 - Total Solutions for Law Enforcement, Security, Facilities Management, Fire, Rescue” Contract period September 1, 2015 through August 31, 2020; and
WHEREAS, Johnson Controls, Inc. has represented that it is qualified by its experience and reputation for reliability and longevity to provide Five (5) VS Portable PTZ Security Units (V5-PSU-PTZ) with NEMA Enclosure, Pan Tilt Zoom Camera, Three (3) Solar panels, Live streaming (no ANALYTICS Streaming Video only) with Blue LED Indication light, installation and Five (5) PSU Gateway Licenses (Connectivity Software Updates) according to specifications required by the City of Newark, Department of Public Safety, Police Division in a manner consistent with the terms and conditions set forth in the GSA contract; and
WHEREAS, the Purchasing Agent, QPA, for the City of Newark, recommends the utilization of this GSA contract on the grounds that it provides and installs Five (5) VS Portable PTZ Security Units (V5-PSU-PTZ) with NEMA Enclosure, Pan Tilt Zoom Camera, 3 Solar panels, Live streaming (no ANALYTICS Streaming Video only) with Blue LED Indication light, installation and (5) PSU Gateway Licenses (Connectivity Software Updates) and 2 years of recurring annual Gateway costs according to specifications required by the City of Newark, Department of Public Safety, Police Division.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of Public Safety, and/ or the Purchasing Agent, QPA, are authorized to utilize General Service Administration Contract GS-07F-190CA “Schedule 84 - Total Solutions for Law Enforcement, Security, Facilities Management, Fire, Rescue” with Johnson Controls, Inc., 264 Fernwood Avenue, Edison, New Jersey 08837, to provide and install Five (5) VS Portable PTZ Security Units (V5-PSU-PTZ) with NEMA Enclosure, Pan Tilt Zoom Camera, Three (3) Solar panels, Live streaming (no ANALYTICS Streaming Video only) with Blue LED Indication light, installation and Five (5) PSU Gateway Licenses (Connectivity Software Updates) at a cost not to exceed $92,779.00, inclusive of 2 years of recurring annual Gateway costs with automatic renewals which renewals shall be subject to available and appropriated additional funding.
2. The term of the contract commences upon Municipal Council approval of this authorizing resolution and terminates on August 31, 2020.
3. There shall be no amendment of this resolution without the approval of the Municipal Council.
4. The Director of Finance has certified that there are available, and sufficient funds, from Department of Public Safety, Business Unit NW051, Department G18, Div./Proj P18Q0, Account # 94550, Budget Ref. B2018 in the amount of Ninety Two Thousand Seven Hundred Seventy Nine Dollars and Zero Cents ($92,779.00) for the purposes set forth herein.
5. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such authorization, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Purchasing Agent, QPA for the City of Newark, to utilize GSA Contract which includes an award to Johnson Controls, 264 Fernwood Avenue, Edison, New Jersey 08837, to purchase Five (5) VS Portable PTZ Security Units (V5-PSU-PTZ) with NEMA Enclosure, Pan Tilt Zoom Camera, Three (3) Solar panels, Live streaming (no ANALYTICS Streaming Video only) with Blue LED Indication light, and Five (5) PSU Gateway Licenses (Connectivity Software Updates) for the period commencing from the adoption of this resolution, to complete delivery no later than August 31, 2020, at a cost not to exceed Ninety Two Thousand Seven Hundred Seventy Nine Dollars and Zero Cents ($92,779.00) inclusive of 2 years of recurring annual Gateway costs with automatic renewals which renewals shall be subject to available and appropriated additional funding.
