Apply and Accept Resolution 7R5-c, adopted on April 5, 2023, accepted a grant award in the amount of $1,600,000.00, for the period of March 1, 2023 through February 28, 2025, from the State of New Jersey Department of Community Affairs’ Lead Remediation and Abatement 2023 Program.

WHEREAS, pursuant to Resolution 7R5-c adopted on April 5, 2023, the City of Newark’s (“City”) Department of Health and Community Wellness accepted a grant award from the New Jersey Department of Community Affairs (DCA), for the provision of lead abatement and minor repairs through the Municipal Lead Remediation and Abatement 2023 Program; and
WHEREAS, on September 13, 2024, the DCA notified the City of an amendment to the grant, awarding additional funds in the amount of Four Hundred Thousand Dollars and Zero Cents ($400,000.00), increasing the grant total to Two Million Dollars and Zero Cents ($2,000,000.00) and extending the period through December 31, 2026. (a copy of the amended Notice of Grant Award is attached hereto and made a part hereof); and
WHEREAS, the City desires to accept the additional funds in the amount of $400,000.00 and extend the time of the grant period until December 31, 2026; and
WHEREAS, the City recognizes that the DCA, may extend the time of the Grant Award and/or provide additional funds, if made available; and
WHEREAS, the Department of Health and Community Wellness shall upon any such extension of time of the grant and/or increase/decrease of additional funds, file an amending resolution reflecting the final term and award amount of the grant; and
WHEREAS, terms of the grant award may only be waived or amended by the parties duly authorized to execute the grant, subject to the approval of the Municipal Council by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. ). This Resolution shall amend Resolution 7R5-c adopted by the Municipal Council on April 5, 2023, to amend the grant period through December 31, 2026 and accept additional funds in the amount of Four Hundred Thousand Dollars and Zero Cents ($400,000.00) from the New Jersey Department of Community Affairs (a copy of the amended award is attached hereto and made a part hereof).
2. The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to accept and expend the additional funds
3. The new grant total shall be Two Million Dollars and Zero Cents ($2,000,000.00).
4. Upon grant authorization and ratification of this Resolution, the term of the grant shall be amended through December 31, 2026.
5. The Municipal Council hereby ratifies the acceptance of this grant amendment from September 13, 2024 to the date of adoption of this authorizing Resolution.
6. The Director of the Department of Health and Community Wellness shall file a fully executed copy of the grant application and notice of grant in the Office of the City Clerk.
7. All other terms and conditions of Resolution 7R5-c adopted by the Municipal Counsel on April 5, 2023 shall remain the same.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark, and/or his designee, the Director of the Department of Health and Community Wellness, to accept additional grant funds in the amount of Four Hundred Thousand Dollars and Zero Cents ($400,000.00), revising the grant total to Two Million Dollars ($2,000,000.00), and amend the period of time to expend the funds through December 31, 2026 from the New Jersey Department of Community Affairs (DCA), 101 South Broad Street, P.O. Box 806, Trenton, New Jersey 08625-0806. These funds shall be used exclusively for the lead remediation and abatement program. No Municipal matching funds are required for the receipt or acceptance of the grant funds.
