This Resolution ratifies and authorizes the City of Newark to request an extension from NJDOT to allow the City of Newark additional time to award a contract for construction of the Municipal Aid Program for Street Resurfacing - Various Streets - 2022 - Newark (20 Locations) MA-22 from October 21, 2023 to April 21, 2024.

WHEREAS, the State of New Jersey Department of Transportation (“NJDOT”) State Aid to Counties and Municipalities FY2022 Municipal Aid Program (“NJDOT Municipal Aid Program”) provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and

 

WHEREAS, on July 1, 2021, the Director of the Department of Engineering, on behalf of the City of Newark (the “City”), submitted an application to NJDOT requesting grant funding from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets - 2022 - Newark (20 locations, MA-22) within the City of Newark, identified as application MA-2022-Various Streets-2022 (20 Locations) for City of Newark with no City funds required; and

 

WHEREAS, on September 1, 2021, the Municipal Council adopted Resolution 7R3-b ratifying and authorizing the Director of the Department of Engineering to apply for, accept, and enter into grant documents for a grant award for Contract #2022-03 Municipal Aid Program for Street Resurfacing - Various Streets-2022 - Newark (20 Locations) MA-22, NJDOT; and

 

WHEREAS, on October 21, 2021, NJDOT announced that the City was selected to receive a grant award in the amount of Two Million Eight Hundred Eighty-Six Thousand Four Hundred Forty-Seven Dollars and Zero Cents ($2,886,447.00) for the construction of Municipal Aid Program for Street Resurfacing - Various Streets-2022 - Newark (20 Locations) MA-20; and

 

WHEREAS, NJDOT requires the City to award the contract for construction of Municipal Aid Program for Street Resurfacing - Various Streets-2022 - Newark (20 Locations) MA-20 within two (2) years of the announcement of the receipt of a grant award, with a deadline of October 21, 2023; and

 

WHEREAS, due to the required environmental screening under the Executive Order 215 (EO-215) by the Bureau of Environmental Program Resources, as well as additional design and coordination for utility infrastructure, the award has been delayed; and

 

WHEREAS, the City of Newark wishes to request that the NJDOT allow the City of Newark additional time to award the contract for construction of Municipal Aid Program for Street Resurfacing - Various Streets-2022 - Newark (20 Locations) MA-22, extending the deadline from October 21, 2023 to April 21, 2024.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to request an extension from NJDOT to allow the City of Newark to award a contract for construction of Municipal Aid Program for Street Resurfacing - Various Streets-2022 - Newark (20 Locations) MA-20 by April 21, 2024.

 

2.                     The Municipal Council hereby ratifies its authorization of this extension request from October 21, 2023 to the date of adoption of this authorizing Resolution.

 

3.                     All other terms and conditions of the grant award from the NJDOT  for Contract #2022-03 Municipal Aid Program for Street Resurfacing - Various Streets-2022 - Newark (20 Locations) MA-22 project shall remain in force and effect until the contract is completed.

 

STATEMENT

 

This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering to request an extension from NJDOT to allow the City of Newark to award a contract for construction of Municipal Aid Program for Street Resurfacing - Various Streets-2022 - Newark (20 Locations) MA-22 by April 21, 2024.  No municipal funds are required.
