This First Amendment to the Agreement will increase the contract amount by $75,0000.00 increasing the total contract to an amount not exceed $226,000.00.

WHEREAS, Resolution 7R5-a adopted on February 19, 2025, authorized the acceptance of Grant Funds in the amount of One Million Seventy-Six Thousand, Nine Hundred Seventeen Dollars and Zero Cents ($1,076,917.00), from the United States Department of Health and Human Services, Health Resources and Services Administration (HRSA), 5600 Fishers Lane, Rockville, Maryland 20857 for the Ending the HIV Epidemic: A Plan for America - Ryan White HIV/AIDS Program Parts A and B; and
WHEREAS, Resolution 7R5-m adopted on June 24, 2025, authorized a sub-award to Newark Beth Israel Medical Center, 201 Lyons Avenue, Newark, New Jersey 07112 (herein "Sub-recipient") in the amount of $151,000.00; and
WHEREAS, Resolution 7R5-a adopted on February 04, 2026 authorized the acceptance of additional grant funds from HRSA increasing the total grant amount received to Five Million, Five Hundred Thirty-Three Thousand, Eight Hundred Forty-Four Dollars and Zero Cents ($5,533,844.00) in addition to a grant period extension from March 1, 2025 to February 28, 2030; and
WHEREAS, the Sub-recipient, based on rising costs, increase in the number of individuals and families seeking support, has requested additional funding from the City of Newark's (the "City") Department of Health and Community Wellness ("DHCW") to ensure the continuity of housing and support services for individuals and their families in the Newark Eligible Metropolitan Area (NEMA) (a copy of the Request letter from Sub-Recipient is attached hereto and made a part thereof); and
WHEREAS, the requested increase in the total contract amount is deemed reasonable and necessary; and
WHEREAS, the DHCW, based on the submitted request, desires to increase the total award amount to the Sub-recipient by Seventy-Five Thousand Dollars and Zero Cents ($75,000.00); and
WHEREAS, the increase of an additional Seventy-Five Thousand Dollars and Zero Cents ($75,000.00) brings the total contract to an amount not to exceed Two Hundred Twenty-Six Thousand Dollars and Zero Cents ($226,000.00) for the period of March 1, 2025 through February 28, 2026; and
WHEREAS, all other terms and conditions of the sub-award remain the same.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, and the Director of the Department of Health and Community Wellness, are authorized to enter into and execute a First amendment to the Agreement with Newark Beth Israel Medical Center, 201 Lyons Avenue, Newark, NJ 07112, to provide additional funds in the amount of Seventy-Five Thousand Dollars and Zero Cents ($75,000.00), increasing the total amount to an amount not to exceed Two Hundred Twenty-Six Thousand Dollars and Zero Cents ($226,000.00) for the period commencing March 1, 2025 through February 28, 2026 (a copy of the First Amendment is attached hereto and made a part thereof).
2. The Municipal Council hereby ratifies this First Amendment from the date of the adoption of this Resolution to March 01, 2025.
3. Attached hereto is the Certification, which states funds the amount of Seventy-Five Thousand Dollars and Zero Cents ($75,000.00), are available in the 2025 Budget, NW051, Dept: G25, Div.: 5h5Q0, Activity: A, Account#: 72090, Budget Ref.: B2025. The Certification shall be filed, along with the Original Resolution and the executed First Amendment contract in the Office of the City Clerk.
4. There shall be no advance payment on the Contract in accordance with N.J.S.A. 40A:5-16. Funds for 2023 and subsequent years are contingent upon appropriations, pursuant to N.J. A.C. 5:30-5.5(d) (2).
5. There shall be no amendments or changes to the contract without the approval of the Municipal Council by Resolution.
6. All other terms and conditions of the Agreement remain the same.
7. The Director of the Department of Health and Community Wellness shall file a fully executed copy of the First Amendment to the contract in the Office of the City Clerk.
STATEMENT
This Resolution ratifies, amends, and authorizes the Mayor and/or his designee, the Director of the Department of Health and Community Wellness, to enter into and execute a First Amendment to the Agreement with Newark Beth Israel Medical Center, 201 Lyons Avenue, Newark, New Jersey 07112 for an additional Seventy-Five Thousand Dollars and Zero Cents ($75,000.00), for a total Contract Amount not to exceed Two Hundred Twenty-Six Thousand Dollars and Zero Cents ($226,000.00) for a period of March 1, 2025, through February 28, 2026.
