WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of Two Million Dollars and Zero Cents ($2,000,000.00), for the CLEP Program, to provide lead exposure prevention, community outreach, case management, environmental interventions, and lead abatement services for children with EBLs of 5 and above and no adequate provision has been made in the 2023 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, by the Notice of Award dated August 17, 2023, the New Jersey Department of Community Affairs (DCA), awarded the City of Newark funds in the amount of $2,000,000.00 The aforementioned program will provide lead exposure prevention, community outreach, case management, environmental intervention and lead abatement services for children six (6) months through seventeen (17) years of age with EBL’s (Elevated Blood Level’s) of five (5) and above (City-Wide); and
WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body, by a two-thirds vote, may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriations adopted in 2023, pursuant to N.J.S.A. 40A: 4-20 including this Resolution total………………$514,691,425.40.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Governing Body by a two-thirds vote of its full membership hereby amends its temporary budget by making the following temporary emergency appropriation:
2. A temporary emergency appropriation be and the same is hereby made for the following classification:

3. The temporary emergency appropriation shall be provided for in the 2023 budget.
4. A copy of this Resolution shall be filed with the Director of Local Government Services by the City Clerk.
STATEMENT
This Resolution establishes the temporary emergency appropriation for the Childhood Lead Exposure Prevention (CLEP) Program FY 2023, in the amount of Two Million Dollars and Zero Cents ($2,000,000.00). The State of New Jersey Department of Community Affairs (DCA) awarded the funds.
The project period is July 1, 2023 through June 30, 2024
