This contract will provide for the supply and delivery of Zinc Orthophosphate for the City’s Montclair Re-Chlorination Station under the direction of the Department of Water and Sewer Utilities.

WHEREAS, on January 17, 2024, the City of Newark, Department of Water and Sewer Utilities (the “Department”) advertised to solicit bids for suppliers to provide Zinc Orthophosphate necessary to treat the water at the Montclair Re-Chlorination Station for the operation of the City of Newark's water utility system; and
WHEREAS, the Department distributed four (4) bid packages to prospective vendors following the date of advertisement; and
WHEREAS, on January 31, 2024, the Department received and opened sealed bid packages from two (2) vendors for the supply of certain water purification chemicals for water treatment at the Pequannock Water Treatment Plant; and
WHEREAS, upon review of the bids submitted, the Department determined that the following contractor submitted the lowest responsible and responsive bid in compliance with Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.:
• Shannon Chemical Corp., 602 Jeffers Circle, Exton, PA 19341 to supply Zinc Orthophosphate at $5.79 per Gallon for Year 1 and at $6.39 per Gallon for Year 2; and
WHEREAS, the Department reviewed the bids and found that the objectives of competitive bidding was achieved, that favorable bid prices were received, and that Shannon Chemical Corp. are responsible bidders capable of providing the products in accordance with the bid specifications; and
WHEREAS, based on the above determination, the City of Newark (the “City”) has determined that in accordance with N.J.S.A. 40A:11-1 et seq., the above listed contractor constitutes the lowest and responsible bidder for the product; and
WHEREAS, the City wishes to accept the lowest responsible and responsive bid(s) submitted and award a contract to each of the aforementioned vendors in the amounts specified in the Bids for the supply of Zinc Orthophosphate for water treatment at the Montclair Re-Chlorination Station, for the period of two (2) years to commence upon the date of the written Notice to Proceed; and
WHEREAS, the award of this contract is necessary for the efficient operation of the City’s Montclair Re-Chlorination Station and pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meets the requirements of the Fair and Open Process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, are authorized to enter into and execute Contract #11-WS2024 for supply and delivery of Zinc Orthophosphate for the City of Newark’s Montclair Re-Chlorination Station with the following supplier of Zinc Orthophosphate for a term of two (2) years, commencing on the date of the Notice to Proceed, as follows:
• Shannon Chemical Corp., 602 Jeffers Circle, Exton, PA 19341 to supply Zinc Orthophosphate at $5.79 per Gallon for Year 1 and at $6.39 per Gallon for Year 2; and

2. This is an open-ended contract to be used as needed during the term of the contract. Thus, for any and all expenditures against the contract, a Certification of Funds attesting to the availability of sufficient funds, as required by and pursuant to N.J.A.C. 5:30-5.5(b), shall be executed before a contractual liability is incurred each time an order is placed from Account Code Line: NW037-750-7502-83230-B2024, covering the amount of the order. This contract be for an amount not to exceed of One Million Ninety Six Thousand Two hundred Dollars and Zero Cents ($1,096,200.00) for two (2) years.
3. It is the responsibility of the Director of the Department of Water and Sewer Utilities to ascertain the availability of sufficient funds before ordering the Zinc Orthophosphate and to assure that the chemical provided is in compliance with the specifications; furthermore, the Director of the Department of Water and Sewer Utilities will provide the Municipal Council and the Business Administrator with appropriate monthly reports during the term of the contract.
4. There shall be no amendment or change to the contract without prior approval by the Municipal Council.
5. There shall be no advance payment made against the contract in accordance with N.J.A.C. 40A:5-16.
6. The Director of the Department of Water and Sewer Utilities shall file duly executed copy of the contract with the Office of the City Clerk.
7. If required by State Law, the Acting City Clerk shall provide the appropriate Notice of the Award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15c-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities to enter into and execute contracts with: Shannon Chemical Corp., 602 Jeffers Circle, Exton, PA 19341 for the purpose of Supply and Delivery of Zinc Orthophosphate for the City of Newark’s Montclair Re-Chlorination Station from the date of the Notice to Proceed, for a not to exceed amount of $1,096,200.00 for two (2) years.
