Purpose: This Ordinance establishes an Auxiliary Police Program to take effect immediately so that the Auxiliary Police may immediately begin their on-the-job training requirements.
Ordinance No(s).: Ordinance 6F-b 051717 (Leg. 17-0297) (copy attached), by which the Municipal Council did, on May 17, 2017, have the first reading of a proposed Ordinance establishing an Auxiliary Police Program.

WHEREAS, the Department of Public Safety, Police Division, submitted for consideration, by the Newark Municipal Council, a proposed form of Ordinance establishing an Auxiliary Police Program which was introduced and advanced to first reading on May 17, 2017; and
WHEREAS, on May 17, 2017, the Municipal Council did, by way of Ordinance 6F-b, advanced the proposed Ordinance to public hearing, second reading and final passage; and
WHEREAS, on May 17, 2017, the Mayor of the City of Newark filed a letter (copy attached) with the Newark City Clerk’s office requesting that a Special Meeting of the Newark Municipal Council be held on May 31, 2017, for the purposes of [i] allowing for the second reading and final passage of Ordinance 6F-b, May 17, 2017, [ii] the consideration of this resolution allowing for said Ordinance to take effect immediately upon public hearing, second reading and final passage; and
WHEREAS, the Auxiliary Police Program will be a critical element within the City’s Department of Public Safety, as a force that will be available to perform activities pursuant to the Annotated Statutes of New Jersey, Appendix A, Chapter 9 (National Defense Title) and other related orders and directives of the State Director of Emergency Management, or the Governor of New Jersey, and the State Civil Defense Act (Chapter 251, P.L. 1942, as amended), in the protection of the public during times of declared disasters, such as hurricanes and floods; and
WHEREAS, there is therefore an emergent need for the Ordinance establishing an Auxiliary Police Program to take effect immediately upon public hearing, second reading and final passage, so that the participants in the Auxiliary Police Program may begin the performance of their on-the-job training requirements as soon as possible; and
WHEREAS, N.J.S.A. 40:69A-181(b) authorizes a Governing Body to adopt a resolution declaring an emergency and authorizing that an ordinance take immediate effect so long as at least two-thirds of all the members of the Governing Body vote in favor of such resolution; and
WHEREAS, the Mayor and Public Safety Director recommend that the Newark Municipal Council adopt this resolution declaring an emergency and authorizing the Ordinance establishing the Auxiliary Police Program to take immediate effect upon the Ordinance’s second reading and final passage.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. As a result of the reasons set forth herein and the important public policies enunciated, an emergency is hereby declared to exist relative to the need to establish, and begin the implementation of an Auxiliary Police Program as soon as possible.
2. The Ordinance establishing the Auxiliary Police Program is hereby authorized to take immediate effect upon the Ordinance’s public hearing, second reading and final passage.
STATEMENT
This Resolution authorizes an emergency to be declared, relative to the need for the establishment of an Auxiliary Police Program, and further authorizes the Ordinance establishing the Auxiliary Police Program to take immediate effect upon the Ordinance’s public hearing, second reading and final passage.
