WHEREAS, the Division of Traffic and Signals, Department of Engineering, City of Newark, advertised for the receipt of bids on January 31, 2012, for Contract No. 02-2012, Installation of Pavement Markings on Various Streets; and
WHEREAS, on February 16, 2012, two (2) bids were received for Contract No. 02-2012, Installation of Pavement Markings on Various Streets, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, based on a review of the bids, the Director of the Department of Engineering desires to accept the bid proposal submitted by the lowest responsible bidder Denville Line Painting, Inc., 2 Green Pond Road, Rockaway, NJ 07866 and execute Contract No. 02-2012, Installation of Pavement Markings on Various Streets with them, for the total not to exceed bid amount of $193,700.00.; and
WHEREAS, presently the amount of $80,000.00 is certified for this contract, and the Director of Engineering is authorized to extend the contract to its full value of $193,700.00, when the balance of the funds in the amount of $113,700.00 is certified upon adoption of the 2012 Annual Budget of the Department of Engineering. A copy of the certification of funds will be filed with the Office of the City Clerk by the Director of Engineering.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
- The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept the bid proposal submitted by the lowest responsible bidder, Denville Line Painting, Inc., 2 Green Pond Road, Rockaway, NJ 07866 and execute Contract No. 02-2012, Installation of Pavement Markings on Various Streets with them, for the total not to exceed bid amount of $193,700.00.
- Attached hereto are certifications of partial funds issued by the Chief Financial Officer, City of Newark, which states that there are available sufficient legally appropriated funds in the amount of $80,000.00 for the purpose set forth hereinabove. Copies of the certifications of funds issued shall be filed in the Office of the City Clerk by the Director of the Department of Engineering together with this resolution.
- The Director of the Department of Engineering is further authorized to extend this contract to its full value of an amount not to exceed $193,700.00, when the balance of the funds in the amount of $113,700.00 is certified from the Operating Budget for FY2012 of the Division of Traffic and Signals, Department of Engineering. A copy of the certifications of funds will be filed with the Office of the City Clerk by the Director of the Department of Engineering.
- No changes to this contract are allowed without prior Municipal Council approval.
- A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
- This contract is to be completed within a period of 365 consecutive calendar days from the date of issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
- The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
- Partial funds in the amount of $80,000.00 is provided as below:

STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Engineering to accept the bid proposal submitted by the lowest responsible bidder, Denville Line Painting, Inc., 2 Green Pond Road, Rockaway, NJ 07866 and execute Contract No. 02-2012, Installation of Pavement Markings on Various Streets with them, for the total not to exceed bid amount of $193,700.00.
This contract is to be completed within a period of 365 consecutive calendar days from the date of issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
